K3 With No Alien Registration Number Traveling Home

I can't begin to say how angry and frustrated I am at the whole sytem for making the Visa process and my wife's integration into society so difficult for us. Each process has been harder than the next and each person I talk to is ruder than the last. I have been nothing but patient...

My wife came to the U.S. with a K3. At the SFO airport the Immigration Officer who opened our Yellow Folder said that I did not need the I-94 form I filled out on the plane for my wife and made me throw it away. He said for her she does not need that form as she has a K3 visa and we would be getting a welcome package in the mail in a month or so which never came, I never got anything! As a result of this one of many inept people working for the government (no offense I am sure there are many smart people too), she has no Alien Registration number and this has caused us so much grief here. They even took her Birth Certificate which I had to get from Germany and neither NVC or USCIS will return it to me. I had to get this again for her coming interview!

I could not do a AOS because of this or even get her a California ID. Countless hours on the web researching and on the phone to NVC and USCIS yielded nothing, I just got the run around and hung up on so many times!

I have given up on the AOS process and she is going back to Turkey in 2 days for her original CR1 Visa US Embassy Appointment (It was rescheduled as the orignal date was back in January which I canceled saying I was going to do AOS in the U.S., we had already got the K3 visa).

Now I am worried that they will not even let her get on the plane to go back to her country of Citizenship without the Alien Registration Number or I-94 form. I read on the web that you should turn this card in before leaving the U.S.:

Please advise before I end up leaving this country too out of my built up frustration. I really feel like they don't want my wife here.

Please answer quickly so if there are any actions I need to act upon I can do that before her flight in 48 hours.

You could have made an Infopass appointment and gotten answers to all of your questions face to face. Of course that may mean you speak with another one one of the many inept people you will leave here when you move to another country. :whistle:

You could have made an Infopass appointment and gotten answers to all of your questions face to face. Of course that may mean you speak with another one one of the many inept people you will leave here when you move to another country. :whistle:

You just need to get the I-94 form from the SFO CBP office. Try this page with all the information for the SFO Port of Entry: http://www.cbp.gov/xp/cgov/toolbox/contact...rts/ca/2801.xml

I contacted SFO CBP office several times and called them directly! They gave me the run around and told me to contact USCIS in the end and they can't help. After DAYS on the phone finally one day I got forwarded to a USCIS Agent who said the stamp in her passport at SFO was enough to prove she came to the country legally and never said I need to get an I-94. THAT ***** then hung up on me in the middle of my sentence, she spent maybe 30 seconds on the phone with me! Disgraceful people not just inept.

I went to USCIS directly and they rejected me from entering or talking to anyone. They said I need to make an appointment on the internet first as it was a new process. This was after another government office (trying to get her a SSN) told me to go the USCIS office directly...

Add 10 more people to the inept people to the list, and this is just one saga of my Visa experience. You have no idea what I have been through, I don't appreciate your sarcasm. You also are not helping me when doing this and adding to my huge built up frustration. If you're going to make fun of me, take a hike. I don't need your help.

Most others in your situation have been able to get the I-94 from the POE. It sounds as if something is not clear in your conversations on the phone, especially with the Information (Misinformation) line staff (who are just reading scripts and not trained adjudicators).

The person that directed you to go to the USCIS office was correct. Did you make the Infopass and go to the office and speak to someone? Yes, the procedure is to make the appointment online. That is where you can speak to a person that is able to assist you.

Did you do this?

What did the person that you met with tell you about the solution to your problem?

That is what I thought as well, getting the I-94 at the POE from research on this site, but after I kept being told to contact USCIS I had given up on that. I must be really unlucky or something with the people I talk to.

I did not schedule the meeting for the info pass. I had decided to skip all the i-94 stuff and getting her a SSN here after I could not even get her birth certificate back (needed for AOS here as well as her I-94). I was going to stop AOS here and continue her CR1 visa in Turkey, why she is leaving the country tomorrow. After we got this appointment date at the U.S. Embassy I got her another birth certificate from Germany and we are going that route now (that is much easier than getting a Visa in the U.S. but still a pain in the rear).

For the birth certificate, both USCIS and NVC did not know where my documents were. USCIS said to call NVC and NVC tells me to call USCIS. The ticket number and search at USCIS resulted in just telling me the same thing, contact NVC!

I was and am still doubtful that making an an info pass appointment will be any help. I am a very patient guy but I am about to having to curse and yell at these people. I have already threatened with law suits to the U.S. Embassy in Ankara for not even returning any of my emails.

I am hoping that they'll just give her a plane ticket tomorrow with her just showing her valid passport and SFO entrance stamp, she is flying domestically than internationally. If I get a problem I will ask to speak with the CBP officer and explain this to them. The USCIS Agent did tell me that the SFO stamp was good enough anyway so this is why this did not come to mind until now. She was recently denied even a California ID because of this so I got all worried about this now.

I am planning to show up 3 hours early to her flight just in case, do you or anyone else think this will be enough time to rectify any problems that come up?

Don't see problems for your wife leaving the country - all she has to show is her passport and a plane ticket.

BTW, on the K-3 visa, she would not be assigned an alien number - that is for immigrants - she'll get one when she gets her CR-1 visa (look at the right column of the CR-1 visa - it will say registration number - that is the Alien number that normally starts with A0 then you add the number from the visa).

For I-94, all you had to do is go back to deferred inspection of CBP to get a new one.

Also, you NEVER send originals to either USCIS or NVC - you send copies. If they want to see it, you bring an original with you.

Thanks! This makes me feel a little better. Hopefully that is how it goes in 12 hours... I'll let you guys know what happens.

I did not ever send them originals, they took it at her K3 visa interview at the U.S. Embassy! I saw her Birth Certificate after the CBP officer opened the Yellow Envolope at SFO and asked for it back but he said no and it will be sent back to us... so I guess there is a big overhead, 10+ months! I hope I run into this guy at the airport tomorrow...

She got her plane ticket without a problem. They didn't ask for anything at the ticket counter except for her passport and eTicket information.

She is somewhere over the Atlantic right now hopefully...

No, I-94 is not used to get an alien number - it just serves as the CBP tracking - each one has a unique number and that's how they keep track where people are. When you leave, you give them the I-94 and I guess they update their system. Only visitors, students and other visa holders need them - PRs don't.
