Hi, I am filling my daughter paperwork. My husban is applying for her because I am not a permanent resident yet. I know I have to fill the following forms:

I-130

I-485

I-864

I-131

I-765

G-325A (here is what I have some doubts)

I read on the I-130 instruction that you will not need this form when you are applying for step daughter /son but you will need to fill this form to add to the I-485 form. My doubt is: how many G-325A form do I need to add with this form (I-485) and what I need to write down in the last part where is says: Applicant: print your name and Alien....... Should I wirte down my daughter name in both (G-325 for my husband as petitioner) and G-325 for my daughter as a beneficary)

Please please help me. I don't want to pay for a lawyer which it will cost me another 500 bucks.

You got that right, the petitioner either has to be a LPR or a USC, goes a bit quicker if the petitioner is a USC, and the key form is the I-130. But what is the petitioner petitioning for? Could be for AOS in which case all the forms are sent in at once, didn't see the I-693 in there, in that case the child is already here legally by other means like on a tourist visa with a valid and current I-94. Or if in the home country, you are petitioning for a visa where you only have to send in the I-130 and wait, bring them here, then send in the entire stack of forms. But this is only if the child is under the age of 21, if 21 or over, the LPR or USC cannot petition for that child if only a step dad. The biological mom has to do that, but only after she becomes a LPR or a USC. While it takes 3 years after she becomes a USC with marriage, doesn't make much difference as if she applies immediately after receiving her green card, as a LPR, the processing time is just about 3 years longer. G-325a has to be filled out for both the petitioner and the alien. The entire stack of forms has to be done for each person coming here. For the petitioner, just fill it out once and print out as many copies as you need.

I-765 is optional, wouldn't bother with that if the kid was preschool age, only buys you a couple or extra months with the EAD so you can get an SS number that much quicker, but a nice legal document to have if the kid is going to school, even though the supreme court is saying the DOS can't do this.

I was able to petition for both my wife and her under 21 daughter at the same time, sending in a huge stack of forms, evidence, also needed proof my step daughter was free to come here with a court document from her biological father and all the other evidence they wanted. But not for my slightly over 21 step son, he has to stay there until his mom was able to petition for him, and that is really a very long wait.

Haven't the slightest idea who writes these laws and the logic behind them and what the USCIS considers to be a family or not.

You have to spell out your situation to get help, they mix everything together in the I-130 instructions, have to separate that to just what applies to you.

You have to do a G-325a for your husband, the petitioner, with his name and background information, and another one for your daughter with her name and her background.

Least this is what my attorney at the time told me to do, one for me, the petitioner, one for my wife, and the 3rd for my step daughter, hers was short as she never was employed, married nor divorced. I used a program where I only had to type in the first of four identical pages, the other three were filled in like the first.
