Is there NO POSSIBLE way she can file a waiver???

If she has children from a USC who won't let her move to JA and she needs him here, does that not qualify her for a waiver...??

If 1 charge of possession for marijuana under 30grams is inelligible for waiver, I do not understand why admitting to using it 2 years ago isn't.

There is no waiver for admitted drug use. It's an automatic ban.

All that is necessary for the triumph of evil is that good men do nothing.

I don't think the panel physicians are testing your blood for trace amounts of pot, but anyways. He admitted to drug use, bad move. I feel horrible for you and I hope you can find a way around this.

You're right. They are most likely running a urine drug screen to look for the traces of THC.

Just offering up my support to you Mrs Hamilton.

My husband used to smoke weed but stopped about 2 years ago.....it wasn't something I agreed with and he chose me over the weed. It was hard for him to give up as he was a habitual smoker, and I was very very proud of him.

Being honest was very commendable of him, and the fact that he gave up should be applauded too.

Sadly the US government does not see it that way. Good luck with your future visa journey. I hope you and your partner can successfully wait this ban out and be together soon.

10/26/2009 - Green Card received - nearly 11 months to the day of our K1 NOA 1!

11/25/2009 - Started my new job!

02/26/2010 - Passed my driving test :-p

07/20/2011 - Eligible to remove conditions

2012 - Going for citizenship

09/20/2011 - Removal of conditions submitted to VSC....here we go...again!

It's been a quick and relatively painless journey thanks to tireless research, dumb luck and this community :)

DONE with USCIS for a while :)

sorry to hear that mrsh but was he denied under 221(g) or 212(g)? i can get some answers for you from an attorney (F)(F) don't worry my dear trust me it will work out :) it just takes time (F)

Visa in Hand: 11/12/09

POE: 01/30/10 (!!!!) at JFK Airport in NYC... can't wait!

Got the green card maybe 8 weeks after 01/30/10...

geez, i feel so bad for you. i know if my hubby was moving to my country i would be concerned as he has had a DUI and has smoked weed. thank goodness i dont do either, and i am clean to go to the USA!

let us know how you go in solving this issue.. i feel so bad for people who get all the way to interview and denial happens!!!!

Nope.

There is NO possible way in my knowledge that he can come here. No waivers, nothing a lawyer can do. He has to wait out the ban and reapply.

In my experience, people who reapply do get approved second time around.

For future reference, ANY admission as to having EVER used marijuana results in being denied.

Just to clarify, I am talking about the JAMAICAN Embassy!! I wasn't asked if I'd ever used any drug at the UK one!

yes minyas wife.. its normal practice for jamaican embassy that if the medical is clean, but applicant admits to having ever used, this means denial..

Aha! The only thing that gives me pause here is that it seems the medical was written incorrectly or falsified(?). If the OP admitted to pot use more than 2 years ago, and now the visa was denied because of it, it makes sense. But the way I'm reading it, the OP admitted to drug use 2 years ago, yet mysteriously the medical form states that OP admitted to recent(2 months ago) drug use. 2 months ago looks worse than having smoked 2 years ago.

Something else...if it is normal practice to deny on medical grounds if there's admitted drug use, why would it matter if the date is 2 months or 2 years? Why would the medical interviewer write the wrong date?

can't try to figure it out.. there has been instances the medical interviewer ADMITS to putting wrong info, but still no recompense..

the date really doesn't matter in the end.. all that matters is yea or nay...

VERY TRUE quanna....this is exactly what happened with me and richard....you know the story there girl......feel free to contact me mrs h if you want any info on what i have and am still going thru with our denial......i will tell you this.....the decision cannot and will not be overturned.....regardless of who you get involved.....you have to just wait out the 3 years......

kids or no kids it doesnt matter......they still have to wait it out.....our babies were 6 months old when we were denied last year and it does not matter......

i am really sorry to hear ur situation , contact a good immigration attorney as soon as possible

FYI...an attorney can't help fix this so save the money you would spend hoping he can......we had an attorney from the beginning of our K1 visa, congress, dept of state, hillary clinton and her staff all involved and final decision after fighting for 8 months was WAIT TIL OUR BAN IS UP AND HE ELIGIBLE FOR A NEW INTERVIEW......that came from the dept of states legal department and they have final say

Mrs H...all I can recommend now is that you two continue to be open and honest with each other about how you want your relationship to be. You're going to have to work out a visitation schedule that works for you all, and just to be honest, it's going to be SOOO difficult emotionally, especially the 1st year or so--but rest assured if the love that you two share is true, it can be done! IMO this will be a testament to the validity & strength of your relationship. And to be real with you, taking a break from VJ will do wonders for you emotionally. Well, it did for me. I took a break from here for almost 2 years...seeing the approvals and adjustments can be extremely difficult and make things worse IMO...I don't know, you'll just have to figure out what works/doesn't work for you. TTYL
