Did you just say, "last used Weed"? I hope that doesn't mean what I think it does.

I know this is hard but you need to be clear if you want help and you need to be honest so that people can be of use to you and hopefully use any of your pitfalls and resolutions thereof, to aid their own cases.

Wait, I'm confused...was it a questionable relationship denial or an overstay/illegal presence denial. OP, please redact the words of the letter that your husband was given at the time of the denial.

IDK, my hubby is saying that it is due to the drug use, but people on VJ keep asking me about our relationship, so I don't know if it was due to the relationship, I am so confused, and drained :(

No, I think the OP said her husband tested clean, but at the time of the medical interview the husband admitted to using more than two years ago, yet it showed a recent date with the heading admitted to last using marijuana.

USCIS

NOA #2: Approval June 25th, 2009 - 92 days

NVC

July 8, 2009 to August 10, 2009 - 28 days

Interview Assigned - December 3, 2009 - FINALLY!!

Medical - December 14, 2009 - Passed

Embassy/Interview - January 26, 2010 Montreal, Quebec Canada - 167 days PASSED!!!

Port of Entry - February 26, 2010 Baltimore International, Maryland

USCIS -- ROC package sent off

November 26, 2011 to Vermont station November 30, 2011 received NOA1December 16, 2011 received biometrics appointment.

January 04, 2012 Biometrics

September 2, 2012, RFE Received.

September 22, 2012 RFE responded to

October 15, 2012 ROC approved, 10 Green card on its way.

Then this looks like a denial based on him having failed the medical examination. Did your husband do drugs so close to his medical exam? Drug use is something that makes on ineligible for a visa....and pot is a drug. Perhaps those in the regional forum for Jamaica can help you, but I do not think there is anything you can do about this. If no waiver option was given, was your husband told if there would be a time in the future when he would be eligible for the visa?

he keeps saying he hasen't used in years, so I don't know.. yes he was told he would be eligible in 2012

yes minyas wife.. its normal practice for jamaican embassy that if the medical is clean, but applicant admits to having ever used, this means denial..

Aha! The only thing that gives me pause here is that it seems the medical was written incorrectly or falsified(?). If the OP admitted to pot use more than 2 years ago, and now the visa was denied because of it, it makes sense. But the way I'm reading it, the OP admitted to drug use 2 years ago, yet mysteriously the medical form states that OP admitted to recent(2 months ago) drug use. 2 months ago looks worse than having smoked 2 years ago.

Something else...if it is normal practice to deny on medical grounds if there's admitted drug use, why would it matter if the date is 2 months or 2 years? Why would the medical interviewer write the wrong date?

I'm afraid nothing can be done until 212. At least nothing to get him a spousal visa to come here...you're free to go to him if that is feasible, or you're both free to move to a 3rd country. But he will not be eligible for a US visa until his 3 year ban is up.

I'm afraid nothing can be done until 212. At least nothing to get him a spousal visa to come here...you're free to go to him if that is feasible, or you're both free to move to a 3rd country. But he will not be eligible for a US visa until his 3 year ban is up.

Thank you for your help, like in the past, I will go and visit him, but it is not feasable for me to move there, I have children, and I don't want to up root them.

He tested CLEAN!

Even Presidents of the US have ADMITTED to smoking in their past...

IMO this law should be CHANGED!!! :ranting:

You can use I-130 in 3 years. Unfortunately, he won't be eligible for any visa until 3 year ban is up.

He has been deemed inadmissible. And the reason for that applies to both I-129 and I=130.

You will need to wait out the ban and have him gather evidence of sobriety those 3 years.
