hey all

just got my imbra rfe, sent it back and settling back in for a wait. we are thinking of having a "destination wedding" in florida ( I am from Minnesota, all the filing is being done with a MN address) and then just kinda staying on and honeymooning for a while after all this nonsense with the visa is over. my question is, we really need him (my british fiance) to be able to work asap so we would want to file to change his status and file for the temp work permit asap ( been told the work permit takes a few months) would we be able to file this paperwork right away in florida or would we have to do it in MN?

You could send the paperwork from anywhere as long as you send it to the chicago lockbox which is the initial processing center for all AOS and EAD paperwork. After initial processing it will be sent to your local office which I assume would be the closest one to where you live in Minnesota.

Processing times for EAD's vary wildly from local office to local office but you should expect your Fiance to be unable to work for 2-3 months at least before the EAD is issued. If you have not heard anything after 90 days from the date on your EAD NOA, then you can request an interim EAD from your local office. Until that time its a waiting game !!

I'm not sure about Flordia, but here in the Twin Cities, we got our marriage certificate the same day we turned it in. They were very understanding about the need for speed.

The only way to get a temp work permit is to go through JFK, but you'll have a hard time finding anyone to hire him for only 90 days, since there will be a gap between that and the EAD. If you want to get the EAD (work authorization) ASAP, as soon as your fiance gets here, get the vaccination suppliment done. We waited 2 weeks to receive the paperwork on that.

As you can see from my timeline, it took more than 90 days to get the EAD through MN, although more recently, it's been going a bit quicker.

Hope for the best, plan for the worst. Plan for your fiance not being able to work for at least 6 months after he gets here. Hope that it's more like 3.

If he fly through JFK then he can get a temp EAD for 90 days starting the day he arrived in the US. If you also file his EAD paper asap after he arrived then he should have a chance to get the EAD or at least the interim EAD in 90 days .. (he can make the INFOPASS to get the interim EAD if the processing time pass 90 days from NOA1) so in some case if you are very very speedy.. then he might have like a few weeks of gap. but if you wait for a while like me, then there would be like a few months gap.

K-1 = 4 months

AOS = 5 months

I-751 = almost one year

For the purposes of working whilst a "renewal application" is in progress, no. It's not the same classification of EAD, and therefore, the new document cannot be deemed a renewal.

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.
