Permanent residents and unemployment

Just a qiuck question,

If a permanent resident is laid off, are they eligible for unemplyment if they meet the criteria? or is that reserved only for US citizens?

check with your state unemployment office website. the issue will be addressed in their FAQ or elsewhere. generally, the answer is yes, if the immigrant worked enough quarters and made enough wage.

Anybody who pays taxes is entitled to unemployment insurance.

Anybody who pays taxes is entitled to unemployment insurance.

Not true. An unemployed person can only collect if their previous employer paid unemployment insurance for them. States establish rules for which employees they MUST pay for unemployment insurance. In most states, they are not required to pay unemployment insurance for part-time, temporary, or contract employees. Self-employed workers are usually not required to pay for unemployment insurance, either. When these workers become unemployed, they are not eligible to collect unemployment benefits.

Many states also establish rules for when an employer must provide health insurance and retirement benefits for their employees. Many states require an employer to provide these benefits if the employee is full-time (i.e., 40 hours per week). As a result, many employers in these states will not give full-time employment to workers in low-wage positions because of the substantial additional cost of providing these benefits relative to the wages of the worker. Instead of hiring two full-time employees, for example, they will instead hire four part-time employees. As a result, a substantial percentage of workers in the US are not eligible for unemployment benefits.

Won't this affect in the filing for the removal of conditions whatsoever?

I am thinking of filing but it seems I do not meet the requirement of 40 hours per week.

September 30, 2014 - Interview and Oath-Taking :joy:
