Any K-1 filer want to share an RFE?

Hello all,

I got an email today stating a Request for Evidence. I have not recieved the actual hard copy yet. I just wanted to know if anybody that got an RFE can share what they are looking for. I already checked out the RFE master list, but some of the posts are really outdated. I want to hear some recent request for evidence from people this year. I have been told that RFE's are not usually bad, and your approval follows shortly. Believe it or not I am just happy I heard from USCIS. Still anyone want to share what kind of things they look for. Could it be something really simple?

Passport for me .... and I forgot to sign 2 of the pages for my G-325 ... However my RFE had 3 canned sections ... but I believe all 3 sections where linked to the photo copy of the passport ... basically one of the sections said if no stamps in passport .. or date imprinted photos you can include this blah blah blah ... than had a section at the end about having all documents translated if not in enlgish.

Just be patient and wait for the hard copy to arrive and then address the request(s). An RFE can be for any number of things.

Yes, having patience is not my best quality...:lol:. Just a tad big discouraged because I hired an attorney for my K-1 process and was not expecting an RFE.

The bulk of the work done by the so-called "attorneys" is by their clerical staff.

The job of the attorney should be to check it for completeness, but I'm guessing

that doesn't happen with all of them. In one of the documents I received with my

divorce decree, they misspelled the word DIVORCE! Luckily it wasn't something

that was essential to proving I was divorced, but my lawyer did apologize for that.

Ultimately it's your responsibility, even to check the lawyer. God knows I picked up

the slack countless times, but luckily after I changed lawyers things moved a lot faster.

We are not using any lawyer for the K-1/I-129F process. I will just check everything

3 times and then double-check. If I get an RFE, so be it but that's not the end of the

world because they are telling you what needs to be satisfied and that should be doable.

Remember, the lawyer can't speed things up, he/she is there because they have more

experience (???) than you do. I don't think any lawyer has an "inside track." It's

mostly stroking & hand-holding. :thumbs:

In some countries the accepted practice is that a lawyer (or someone who acts in a capacity similar to one)

will know who and when to bribe in order to get the administrative BS done with minimal hassle.

That's not likely to help any of us here, although I did see on another thread an open question about the

"B" word as if the poster thought that was an option with consular staff. :huh::o:rolleyes:

I also had no choice as to what went into the package and he just wanted to leave it up to the "professional".

I mean, she didn't even use the photocopies that I made of things and wrote on in red ink, she probably photocopied my photocopies.

(I think anyway... he didn't even get a full photocopy of what she sent in, ugh. Sure I have everything, but I cant read minds as to what she sent).

If anyone ever does anything for me ever again, I'm attaching sticky notes to everything :P

But I guess ranting about it won't fix my RFE.

I wish I had known about VJ before and gladly would have done it myself. I actually sat in the office of the legal assistant when she was typing my forms, and I am positive I would have done a better job. Then the attorney had done a final review do make sure everything was ok. I really don't know what it could be. Just have to wait it out and see.

If any Ecuador filers are reading this, and if you didn't pack your I-129F filing with all the "evidence of relationship" that you could muster, your receiving an RFE is a blessing in disguise. Send the USCIS what they request, and send the proverbial "kitchen sink" of relationship evidence along with it -- absolutely everything that you can lay your hands on. USCIS will not care about it, but your sending it now will guarantee that the consulate cannot kick your fiance(e) out of the interview by claiming "insufficient evidence." Because USCIS will have seen the relationship evidence and forwarded it with everything else to the consulate, the consulate will have no excuse for its usual tricks.

For Ecuador (and likely for other tough consulates/embassies), include testimonial letters from others. See the U.S. Consulate forum and the thread entitled Getting "Testimonial Letters" for what to do.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
