hi

we are doing the same thing. our son was born 8/13/2009 at a cost of about $16000.00

Hospital Inpatient Services is working with us to get us emergency Medicaid.

my wife was denied from what they told us it was because of nonCitizenship.

our case worker told us that this was wrong and that she keep working on the case.

we have done some reseach of our own and passed this on to our case worker.

as she has told us it is easy for them to deny our case and move on to the next one

Question: What are the rules for emergency Medicaid services?

Answer:

Special rules apply to Medicaid coverage for emergency services. Emergency Medicaid coverage is limited to treatment required after the sudden onset of a medical condition (including labor and delivery) manifesting itself by acute symptoms of sufficient severity (including severe pain) such that the absence of immediate medical attention could reasonably be expected to result in -- (A) placing the patient's health in serious jeopardy, (B) serious impairment to bodily functions, or © serious dysfunction of any bodily organ or part.

Citizenship and Immigration Status: If a non-citizen, who is not eligible for regular Medicaid, qualifies for emergency Medicaid coverage, by law, the applicant is not required to declare or provide proof of his or her immigration status. States may not deny benefits based on an applicant's failure (or that of a person acting on behalf of the applicant) to certify or document his or her citizenship or immigration status or the citizenship or immigration status of any other person or persons in the applicant's household. (Social Security Act ? 1137(f); 42 U.S.C. ? 1320b-7(f)).

Social Security Numbers (SSNs): If a non-citizen, who is not eligible for regular Medicaid, qualifies for emergency Medicaid coverage, the applicant cannot be required to provide an SSN. States may ask for an SSN if they clearly inform the applicant that provision of this information is voluntary, and if they state how the information will be used. States may not deny emergency Medicaid benefits because a non-citizen does not provide his or her SSN or the SSN of anyone else in the applicant's household. (Social Security Act ? 1137(f); 42 U.S.C. ? 1320b-7(f)).

Emergency Medical Assistance (EMA) For Non-Citizens

Noncitizens, who are Medicaid eligible except for their citizenship status, may be eligible for Medicaid to cover a serious medical emergency. This includes the emergency labor and delivery of a child. Before Medicaid may be authorized, applicants must provide proof from a medical professional stating the treatment was due to an emergency condition. The proof also must include the dates of the emergency.

2030.1100 EMA TO INELIGIBLE NONCITIZENS (MFAM)

To be eligible for Emergency Medicaid (EMA) benefits, the noncitizen must meet all technical (including residency) and financial requirements for a Medicaid coverage group, except: citizenship, child support enforcement cooperation, and welfare enumeration (SSN).

2030.1100.01 Coverage of Emergency Only (MFAM)

Medicaid benefits may be authorized to cover the emergency situation only. An emergency medical condition is a medical condition of sufficient severity (including severe pain) that could result in placing the individual’s health in serious jeopardy. This includes emergency labor and delivery. Accept the provider’s statement regarding the emergency and dates of service.

A medical provider or Utilization Review Committee (URC) will determine if an emergency medical condition exists. The URC is a group affiliated with a hospital which determines an individual's need for emergency treatment. The provider or URC will also determine the length of time the emergency situation is expected to exist.

An applicant may receive retroactive Medicaid (RMAO) and posthumous Medicaid for a deceased individual under EMA if eligible.

1430.0100 CITIZENSHIP/NONCITIZEN STATUS (MFAM)

The eligibility specialist must evaluate the citizenship/noncitizen status for each individual applies for Medicaid. Citizenship information of those family members who are not benefits is not required. Non-receiving members are to be asked only if they are noncitizens, not their U.S. Citizenship and Immigration Services status. The criterion section does not apply to the Emergency Medicaid for Aliens (EMA) Program.

I gave birth here in the US last November 25... and my application for emergency medicaid was appoved. It was effective from the time I checked in the hospital up to the day I got out. So that's total of 3 days. My baby's medicaid was approved too since he is a US citizen.

well.. i want to know if im resident but i don't have insurance and nothing and ....getting pregnant ..so , could i get medicaid without my sponsor have to repaid all that??? im talking about pregnancy stuff ...because we re worry about that and it will be so expensive.

thanks for the update ria, im hoping for the same successful outcome, im due this november. i hope idaho has the same medicaid provisions in florida. its so ridiculous how expensive those hospitals charge.

hi! i just wanna know or ask what did you do that your emergency medicaid was approved? coz i'm also preganant right now and in my 4th month.. and like you i don't have any insurance. and i was thinking of going home in the pinas to gave birth... coz i know its so expensive to gave birth here especially i will be having a c-section again... right now i'm seeing a doctor for my pre-natal of ($2200) for c-section..(hospital stay and epidural not yet included). i hope you can share with me or hope you can give me some idea how you emergency medicaid has been approve... thank you so much...
