Pursuing both K3 and CR1?

I have read on numerous posts about how people pursue both the K3 and CR1 applications to see whichever one gets completed first. Does anyone have experience on following up on both after receiving their NOA2?

What about the fees? If you want to stay on track with both applications, do you have to pay for all the fees associated with both of them?

Yes you will have to pay the $470 to NVC. $400 for the IV bill and $70 for the AOS. Better to just forget about the K-3 and go for the CR-1. If you decide to go with the K-3 you will have to pay $1010 once your SO is here to get the green card.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

"Give me your tired, your poor, your huddled masses yearning to breathe free, the wretched refuse of your teeming shore. Send these, the homeless, tempest-tost to me, I lift my lamp beside the golden door!"

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Welcome to the USA!!!

Do you have any idea as to how much of a time difference there would be before my SO could join me in the US?

Additionally, I am in Pakistan with him right now (I spend a couple of months with him here so that we are not apart for too long)- would I be able to continue with the NVC while I am away or will the whole CR1 process be halted until upon my return?

Thanks for all your help!

you can not or should not follow up on both , if you want to go K 3 route then you must hold on to 130 approval , in other words do not send or pay any fees etc . but if you send 130 forms then k3 and 130 can clash at embassy leval & in some cases this clash can make your case longer because i have heard at embassy leval they preffer to give you cr1 and some time they change your k3 interview to cr1 and it can creat a longer wait and confusion . again this my openion . pray hard and think which route you have to go . k3 is expensive and your husband can not work right away . if you can afford that then my suggestion is follow k3 . i did this for my husband and worked fine for us . Good luck any stay away from AP Monster . it is very hard to doge AP but if your Husband has less Factors then your AP is less longer .

Trying to figure out the time is not easy. Not everyone updates their timeline on VJ and it depends on the USCIS center your case is at. There will be a difference in time before the interview once you get the NOA-2 depending on the visa you are trying to get. For my own case it is looking like two months difference between the K3 and CR1 but I have to evaluate it often and compare it to others who filed before me. To me it appears to be taking longer to get a visa for those who filed before me but it is hard to say. I think the other poster is correct. If you decide to go forward with both visas you actually will interview for the CR1. This is not a bad thing but you have to be prepared and have the documentation for the visa you are applying for. The reason it may take longer if you go with both visas is that there is generally a longer delay to interview for the CR1 vs K3 if you look at the timelines.

Thank you very much for your responses!

Baji: I do believe that praying is key- since its Ramdhan I was up praying Fajr and making duas that my I would get my NOA2- I checked my email the following morning and there it was :)

Its not even about the money with the K3- I read around about it being just an extra hassle...I'm concerned with the fact that I know if I want to go with the K3 since I am in Pakistan for at least 6 months right now with him, it will not pose as an issue. I am more concerned with CR1 and following up with the NVC while I am here. Will I be able to send everything to them from here?

BRB: do you have any idea as to how much of a delay there is between the CR1 and K3 interview these days?

I pursued both and the CR-1 wound up being faster for me. I didn't know it would turn out that way until we were well on our way through NVC. It's not just that the K-3 costs more. There are lots of other downsides, like not being able to work, having to fill out all those forms again, wait in limbo and possibly be called in for yet another interview, etc.

It is possible to continue with NVC while you're abroad. As long as you have access to a reliable way to mail things to them (FedEx) there won't be any problems. NVC will e-mail you all the fee bills if you give them your e-mail address, so you don't need to receive any physical mail. Are you going to have access to everything you need to fill in the forms, like the documents for the affidavit of support? As long as you're able to obtain everything there's nothing wrong with sending it from outside the U.S.

The difference between the interview times is dependent on the country, so you should check in with the people going through Pakistan right now. In London I got a CR-1 interview much more quickly than the K-3, but that's different from embassy to embassy.

Thanks for your guidance.

I brought my tax returns with me and left copies in my home in New Jersey with my parents so that I would have access either way. My joint sponser is in America so I guess I should ask him to fill out the form and forward all the documents to me here so I can verify that everything is in tact. FedEx is an option here so the delivery basis is covered. I'm just worried that this whole thing is going to become a tangled mess so I am trying to cover all my bases and get as much as information as I can.

If anyone has any experience of pursuing both via Islamabad, please do let me know what worked out for you!!

Just my two cents - we've gone through a lot of hassle with the K-3, so I vote for the CR-1, that is, if you're interested in simplifying your lives. I'd certainly seek out all of the embassy specific information you can before making the decision, though.

Looks like interview time is 60 vs 170 days from NOA-2 to interview if I am reading it correctly.

Thanks for the references- K3 if you add in the NVC processing to the interview seems like 90-100 days and 170 for CR1...basically another 2 months almost....

my biggest fear is AP... my hubby has a really common name- so I do not know what to expect

You're gonna have the Pakistan problem not matter what route you go. They seem to put everyone on AP there.
