SSN, Marriage and Name Change Question

Hello,

I've seen similar questions to mine being asked, but the answers weren't quite clear to our exact situation, so here it goes:

My fiancee and I are getting married tomorrow (Fri) and we haven't yet filed for an SSN for her, since we were told to wait two weeks to "get the name into the system" before doing so, and she's not even been here for three weeks yet. We have our marriage license, however.

We asked about applying for an SSN, and were told it doesn't make much sense to apply for a card before we get married and my fiancee's name changes after the wedding. We were told we should just wait and apply *after* the wedding, for a card in her new name.

Is this an acceptable idea? We'll be applying for AOS shortly after the marriage or whenever it makes the most sense, and we'd like to have her be ready for employment and when EAD is granted.

I am not sure how things work with applying for the SSN and AOS with the whole name change factor, especially as far as identifying her as an individual already in the I-94/K-1 system goes.

Is this an acceptable idea? Well it could be - but if you need the number/card, you should do what you need to do.

We'll be applying for AOS shortly after the marriage or whenever it makes the most sense, and we'd like to have her be ready for employment and when EAD is granted. I'd apply at your earliest convenience (obviously you'll be busy tomorrow) but before the I-94 expiration date (actual no later than 14 days before the I-94 expires).

I am not sure how things work with applying for the SSN and AOS with the whole name change factor, especially as far as identifying her as an individual already in the I-94/K-1 system goes.

Actually, I already did that a few times. It's clear on what needs to be done, but not so much about how important the order of them is, and the reasons behind the order and system, etc.

We got married a couple of weeks after Linh entered on a K1, then applied for her SSC with married name, AOS, etc. No name change issues as the marriage certificate is the primary evidence.

Go ahead and get a few certified copies of the marriage cert. so that you can submit them as needed. (Here they were just a few dollars each, I understand the cost can vary).

The only thing that Linh did with her maiden name after the POE was sign the marriage license application. Never any problems.

Brother Anh is spot-on again. After my marriage, I ordered SEVEN certified copies... and, after all the official uses and giving souvenir copies to mothers, etc., we have ONE left.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

We applied for my husband's SSN after we got married. We hyphenated both our names (note, the marriage certificate did not state our new names), and we had no problems using the certificate as proof of our name change with SS. The lady said it would take a little longer to get his SS card because we didn't get his card before the marriage/name change, and it took about 3 weeks for him to get it.

As to the poster with the cert copies... I ordered 3, and so far have used 1 (for AOS filing). Every other place has accepted a photocopy of the cert'd copy unless it was something I needed to do in person... like the bank and DMV.

05/14/08 Engaged on my last day while visiting Bremen

07/03 Mailed 129f package

07/24 NOA1

12/05 NOA2

12/27 Packet 3 received

01/19/09 Medical in Hamburg

03/24 Successful interview at Frankfurt

03/31 Visa received

08/28 NOA1

10/28 Biometrics completed; EAD card production ordered

11/07 EAD arrived

12/14 Successful AOS interview in Seattle
