ya. you file the spousal visa, go thru the whole process of that and then just get a "you arent eligible for the visa" response at your interview...then come the waviers.

I was wondering, if he got deported 7 yrs ago with a 10 yr ban, then arent you banned for 3 more years from here???

Thats why people file waivers...they are "waiving" the ban

yah but from what he wrote, it looked like he didnt file the waiver yet and thats hes waiting on a first interview???

Thanks SO much. I received TONS of support from my MENA VJ family here through so much of it. I took a trip over to the waiver section today for a look see because I haven't been over there in so long. I happened to see a couple of people suggest www.immigrate2us.com and I'm pretty sure THAT was the website I was thinking of that was so helpful but confused it with VJ's waiver forum.

Hicham and I have been through SO MUCH and it's been very difficult for us at times...the process...the separation...the adjustment when he got back here. We are still a work in progress, but we are at the 9 year mark and still hanging in there. Despite the difficulties, Hicham IS a good man.....and he is the BEST father to our son.

iknow exactly what a uphill battle that we are going through,i went to usa in may 1998 on b1/b2 visa got into trouble when i was living there(stupid ,foolish,earhead) call it how ever you i agree with you all,but bellive me life wasnt either easy for a illigal allien especialy after 9/11,and in next january its going to be 7 year since ive been deported,it become even more harder especially for my baby,and what kills me evryday in this past 7years is that i know that i am the one who put us on this horible ordeal.

so now we decide to start the process ,we hired a lawyer from ALIA members in boston for our 1212,i601,we had to wait because of my ofences (otherwise wil be already denied)so basicly the more you wait the more you show rehabilitation and have more chance to get (maybe)approved ,and ALOUSSA ive been in immigrate2us.net,actually am a member there it is a wonderfull site , and i know exactlly what kind of process that is waiting for us and i also saw you on the chat with laurel scott,thank you for the advice you not harsh or anything but thats the reality of this process, and am glad to see that you made it.

my problem now is if we started our i130 in nov08,got approved on april09,i caled NVC (thank to magic jack) yesterday they told me that they already sent the 1rst packet back to my lawyer on april09 and they didnt hear from her yet ,its seem odd to me, we both me and wife have called her and left her messages so she can call us back.

is that normal or its just how it goes??????.

If it was me.... I would try to contact the lawyer one more time. If she didnt call back within a few days, I would advise NVC that I wanted to be the one who received all of the correspondence(i dont know how you do that exactly, but im sure they would help if you called and asked). Then you and your wife go forward with that part of it and know that everything is moving along at NVC. The first thing sent from NVC is the AOS fee bill. Like I said earlier, the lawyer needs to respond to that and follow the instructions or your case will just sit at NVC and not move.

4 months is inexcusable to me personally.

my husband was put in AP for the next year and a half....

how come they put him on AP???? i hurd that they give you your 2nd appointement withing 30 days after the second one????and why???

another thing,isnt the backlog is for only cdj not for the other consulats or embassies????.

They put him in AP because they could. I do believe that is pretty standard across the board, now the wait times...those are not standard and are all across the board. What I learned from our experience is that waiver processing doesn't follow the same rules as other types of cases. The only part of the process that WAS predictable was the estimation of time that Rome gave for processing his file once it got there.
