First time I sent it back it included:

2 affidavits of witnesses

our letters to each other

Picture

Bill for both names for hotel

Thats all I had!!

Then they probably lost it. So I sent it again later. My second attempt of RFE didnt include 2 affidavits of witnesses though.

So now they said it was INSUFFICIENT.

So what do i do next? What did you guys sent them for good faith?

By the way, does affidavits from friends and family have to be notarized?

November 21 2008 NOA1

November 25 2008 RFE #1 received [good faith + good moral character].

January 7 2009 RFE #1 sent back.

June 9 2009 received a letter "Response to RFE #1 received on JANUARY 13, and case processing has resumed"

It seems really thin.

Do you have any financial proof? Bank statements?

No. His credit was ruined. He didnt have any bank accounts. Neither did I.

How about some more affidavits? Do they have to be notarized?

I sent 2, but it seems like they didnt get it in a first time.

now that looks thin even for a good faith waiver! VAWA needs a pile of evidence.

If this is all you've got, then I'm afraid your case doesn't look good at all. You need to provide evidence that you actually lived together as a married couple. This usually means things like co-mingled assets and debts; i.e., joint bank and credit accounts, both names on a lease, title, or mortgage, both names on utility bills, etc. Letters to each other would probably not be good evidence at all. Married people don't usually send letters to each other because they live in the same household. Affidavits are usually considered in support of other evidence. On their own, affidavits are weak evidence. USCIS is well aware that people will often willingly lie to help their friends or family members. A hotel receipt makes it sound like you had an affair, and not a marriage.

An affidavit is usually a SWORN statement, so you would want them to be notarized. Since your evidence is very weak, it would probably help your case a lot if you could get an affidavit from someone with good standing in your community who is not just a friend or family member.

Is anyone helping you with your VAWA case, like an attorney or charitable organization?

well when i left to the shelter all i had on me was my purse and my laptop. we had mail to the same address and bills and lease, but at that time i just didnt know that i would need it. so as a proof of residence together i had witness affidavit stated that she was coming over to our house and she saw us living together and so on.

The more you send the better, i suggest you get a letter from a psychaitrist...that helps alot...just try to gather everything u can from every corner...then only your case will be stronger.

I dont have a problem to prove an abuse. I have psychaitrist evaluation. I have problem to prove that marriage was in a good faith. Thats all. What did you send to prove that marriage was in a good faith, JaSmiNe1989?

If your name was on a lease you could go back to whoever rented your apt/house to you and ask them for a copy of the lease or a letter stating that both of you were on the lease agreement.

Also try calling utilities if your name was on them - they may be able to give you some kind of proof.

There are many support organizations for abused women. Some of them are free and they provide your native language translator.

AOS from B1/B2:

It's very helpful when you send in an extremely detailed declaration and affidavits. I didn't have much to prove for good faith marriage, but everything was detailed, from my declaration to my affidavit. I explained to them why I had no joint accounts. But also we had a child involved, so that was a big plus for me. I also sent in tickets of when I visited my wife every weekend for 9 months before we got married. I sent in letters from my therapist, greeting cards from friends and family when we got married with both our names and mutual address. Joint phone bills, her divorce decree from her previous marriage, our marriage certificate, affidavit from 1 of her friend, affidavit from 1 of our mutual friend, affidavit from 1 of my relative, and I also sent in 1 of my medical bills describing injuries I sustained. That's all I had.
