Hi Everyone,

Recently I got approved for K3 visa and I m not sure what to do with my I-130. I will be leaving for the United States very soon. My I-130 is still pending at the NVC and I haven't put it on hold. My wife spoke to her lawyer, and he suggested not to do anything with the NVC and it doesn't matter if my wife does anything about the I-130 or not because I'll be entering with K3 status. Our K3 and I-130 got approved at the same time, and my wife received a letter from the NVC earlier this year saying that if she didn't do anything about the I-130, it will be canceled. My question is if we file for AOS, are we going to have any problems because the I-130 will be canceled.

thanks

They usually end the I-130 petition. Many people decide to go with K3 visa, as it's the fastest route for you loved one to be reunited in USA. Wait for the notice from NVC. Congrats on the approval.

Its been 49 days now since my petition started. It's so frustrating to wait.

please provide your time line.

Best of Luck. Best wishes. Thank you.

For pakistani applicants one never knows which way is faster k-3 or i130... because many males end up getting stuck in Admin processing for months on K-3 and meanwhile loose the i-130 and then come to US on k-3 after waiting for mons or some yr(s) AFTER the interview...and then start w/AOS and then once again the process begins.

So dun expect k-3 to be a faster route..i,e if the applicant is a male, however one might be lucky and get the visa right away! It's all luck w/pakistan

As for I-130 cancelation ,... i dun think it wuld effect your AOS
