According to rules for K1 visas, it is necessary for applicants to obtain police clearances for any country where they have lived "six months or more." Here's a hypothetical example: Depart Philippines and arrive Hong Kong Jan. 1, and on the return depart Hong Kong and arrive Philippines June 30. Is that 6 months? What if the return date to the Philippines is July 1? Is that 6 months?

Let's assume for the moment that one of the examples above is 6 months. Does the Philippines have a record of that? How does the USE learn about it? Would the USE say that it is 6 months?

Okay, now let's assume a HK police clearance is needed. Also, assume NVC has already sent the file to the USE - Manila but the applicant has not yet received any letter from the USE stating that the applicant may call for an interview time. According to the HK Police website, they require a document from the U.S. Government (perhaps the USE or the NVC) indicating the need for a police clearance. Is it possible for the applicant to obtain the police clearance BEFORE getting the letter from the USE indicating the applicant can call for a visa interview? In other words, is it possible at this stage to ask the NVC or USE for such a letter so that the applicant can get the process started?

One more question, once the applicant receives the letter from the USE indicating the applicant can call for a visa interview, can the applicant at that point ask for a letter from the USE or the NVC indicating the need for a police clearance, or does the applicant have to wait for the interview and request such a letter at the time of the interview?

Any help/thoughts would be appreciated.

(1) it is necessary for applicants to obtain police clearances for any country where they have lived "six months or more." -- i suggest that the person concerned just go ahead and get the police clearance from hong kong. i met someone during my medical exam who overlooked to get a police clearance from dubai and the embassy had to hold her visa until such time that she had the required document. but technically her total length of stay is less than 6 months if she left jan. 1 and returned to the phils june 30. this is just my opinion. maybe others have a different viewpoint.

(2) Does the Philippines have a record of that? How does the USE learn about it? Would the USE say that it is 6 months? -- in one of the forms that the applicant has to fill up, she/he will need to indicate her place of residence in the past 5 years and the passport stamps will also show that she/he was out of the country for that specific period if she was living overseas. if she is a documented OFW, the POEA will have a record.

(3)According to the HK Police website, they require a document from the U.S. Government (perhaps the USE or the NVC) indicating the need for a police clearance. Is it possible for the applicant to obtain the police clearance BEFORE getting the letter from the USE indicating the applicant can call for a visa interview? In other words, is it possible at this stage to ask the NVC or USE for such a letter so that the applicant can get the process started? -- based from my experience in singapore, the police will not issue any clearances unless one can produce the letter from the USE. (letter would indicate the person concerned has a pending visa application with the USE and a police clearance is required blah blah or something to that effect).

(4) last question, no idea as i received the letter from USE indicating my date of interview and medical exam. forms that are needed to be filled for the interview and medical exam are also attached.

In my case, I had to request Police Clearance from Dubai cos I worked and lived there for more than 4 years. They did not ask for a letter from US Embassy but it was NECESSARY to put FOR US VISA APPLICATION or FOR U.S. IMMIGRATION purpose on the application form. I've heard before that they check the in and out of the country of the applicant..I'm just not sure.

REMOVING of CONDITIONS
December 22, 2011-- I-751 mailed
February 28, 2012-- Biometrics done

October 10, 2012-- 10-yr GREEN CARD received
NATURALIZATION
January 09, 2013-- sent N-400
January 28, 2013-- Biometrics

May 22, 2013-- Interview Passed- Officially a US Citizen!
