I am a us citizan and would like to file for my brother in law to come here to work with me. My husband is a perminant resident. Can I file for my brother in law to come here to work? I own a business.

In order for a US company to hire a foreign worker and bring that person to the US, the US employer must show that there is no US resident who qualifies for that job could be hired by the company. If you can find a US worker, then you do not need a foreign worker. So you need to certify to the Dept. of Labor that you could not find a US resident qualify for the job. Hi-tech workers (Ph.D., scientists, engineers), artists, athletes and famous people offer unique talents that are hard to find, so they generally qualify for work visas as it may be hard to find US residents with their unique talents.

It is impossible to apply for a work visa for someone in a non-highly skilled position.

An application for a work visa for a family member is highly suspicious as it could be viewed as a means to circumvent the family based immigration system.
