If you are a legal resident of Mexico DCF is the way that you would want to go. When you move to US upon approval he would have a green card.

If you have been legally residing in Mexico for at least 6 months, you file for the spousal visa through the US embassy.

I'm not a resident, but I had an FM3 (work visa) and recently switched to an FM2 (dependent of my husband) since I'm no longer working. I've been living here for 7 years. Does that count even though I'm not a resident? I noticed that there are two ways to bring a non-US citizen spouse to US---immigrant visa and non-immigrant visa? What is the difference between the two?

What's the difference between IR1/CR1? Which one EXACTLY do I apply for?

You apply for am immigrant visa... the consulate will determine the proper class (CR1 - married less than 2 yrs, IR - married more than 2 years)

OH I see! So the process/paperwork for either is the same? At the interview, it will be determined?

There is but one process.... but the answer is yes, it will be determined at interview
