Hi all,

My fiance (from Australia) & I will be getting married here in the United States on September 14 (L) . We will be filing for a K-3 visa of course but have a question as to when you need to file an affidavit of support. We have this all lined up as we know we will need one as my income is not enough to sponsor him alone.

Anyone have any experience with this as to when these papers get filed?

Any help would be appreciated and thanks in advance.

Also can't wait to start my timeline and share with everyone else!!!

You will want to file for CR-1. K-3 is obsolete now.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

You will want to file for CR-1. K-3 is obsolete now.

Absolutely. The I-864 is not applicable to a K3 visa anyway. The I-864 will be used in the CR1 process AFTER the petition is approved.

Your question indicates you have not yet carefully studied the appropriate guide. It's critical to your success that you do that as well as to carefully study the instructions for all the forms you'll be filing.

Welcome to VisaJourney!

Depending on whether you are applying for K3 or IR1/CR1, the US Citizen spouse (USC) will be instructed to prepare an Affidavit of Support form (and its supporting documents) sometime after s/he receives the NOA2 (which is the approval notice of your petition).

Depending on the consulate, they may request the petitioner to prepare an I-134 Affidavit of Support form, or a I-864 Affidavit of Support form.

The VJ Guides are very helpful for new members like yourself who are about to begin the journey. We highly recommend that you and your spouse go over them for more information. If there is anything there that does not address any unique or unusual circumstances you may have, then this is a good place to have those concerns addressed...the VJ members are very friendly. :)

02-23-2018: Date on Biometrics Appointment Letter (Biometrics Appointment at Jacksonville ASC on March 13, 10:00 a.m.)

03-08-2018: Biometrics complete

04-05-2018: Case status updated - Interview Scheduled on May 10, 2018, 10:15 a.m. :D

05-10-2018: Citizenship Interview - Passed English and Civics Tests, Recommended for Approval! :D 

06-19-2018: Received email and text notification: Naturalization Ceremony Scheduled; waited for letter to be uploaded on online account - it has been set on Wednesday, July 25, 3:00 p.m.

07-25-2018: I am now a U.S. Citizen!

Sorry took me so long to get back to you all...but thank you...I jumped to fast when I asked my question. I'm sure you all know how that goes, your mind starts to go all in circles every time you read and reread something. You feel like "crazy gaga" is right around the corner.

I did find the insturctions and boy are they great...I'm tossing out all the other useless info I have as these say it all and make it all perfectly clear.

Just a short intro about Austin and I. We met a bit over 5 years ago via the internet and have spent a whole lot of time going back and fourth to visit etc. We at one point thought I'd move over to Australia but I have multiple sclerosis and after 6 months there I just could not take the heat so that pretty much made our decision to marry and live out here. I can't wait. I know will be another long haul but one that is so worth it.

Again thank you all...and I look forward to starting my timeline here.
