I was in the process of the K1 Visa with my US Fiancee. Despite just receiving our NOA2, we have both ended that relationship amicably for our own reasons. I am considering having my US Citizen father petition for me, his son, with the I-130. I know a bit about the K1 but not about immigrating through a family member. I have been reading about it here on VJ.

Does the fact that I was (am) in a K1 process affect the possibility of entering into and being sponsored for family based immigration? I am just planning on abandoning the K1. Is there anything we should do to terminate it and clear my name/slate for the I-130?

I can't seem to find timelines on the I-130, can anyone point me to it or give me an approx. timeline? I am in Canada, my father is the Florida.

Do they look into the parent's finances as closely as they do for a fiancee in the K1? The I-130 form and what is required looks very simple compared to the I-129f package.

Thanks in advance for some feedback on this..... I'm sure I will have more questions.

K1 would have no effect on a I-130 application from your father. The wait time for a unmarried child over 21 is about 6 - 8 years. So even if your father applied now you would still have a long wait ahead of you.

6-8 years? This doesn't even sound realistic. And if that is accurate this route is not an option for me. Does anyone have links to this stats/info? I can't find much on the VJ site or the USCIS site. From what I can see the I-130 processing takes a little longer than the k!...??

See here for the I-130 petion they are approving now out of VSC ( where you dad would file )

10/3/10 POE JFK all went well

I-130 for an unmarried son or daughter over 21 is not classed as an immidiate relative so a visa number is not available as soon as you file you have to wait for a visa number to become available. Only spouses, parents and minor children are immidiate relatives.

The I-130 is just the first part of the process, once the I-130 is approved it then gets sent to the NVC where it will stay until a visa becomes available to you. The wait as said by others and shown in the link to the state department is about 6 years from your priority date (date USCIS received the I-130).

So yes you do have a long wait for an interview.
