petitioning kids

Hello we are new to the site, we are well into the process and am just waiting for the interview date for her Greencard.

My question is regarding her 2 kids that we would like to start petitioning, i know they are able to follow on her

K-1 and would like to know which forms i need to look for on the USCIS site and if there are any unexpected issues that could arise.

A couple of questions....

Did you include the children on the original petition for K-1?

How long has it been since your fiance arrived in the USA?

Assuming that you included the children's names into the original petition of your fiance (now wife), then they were also approved when your wife's petition was approved. As long as it has not be over a year since your fiance/wife arrived in the USA, then they can follow-to-join with a K-2 visa. All you would need to do for the K-2 if they are on the original K-1 petition is contact the US Embassy in Manila and ask that an interview appointment for your K-2 children be set-up. No other petition is needed.

If you did not include them on the original K-1 petition, then honestly I am not sure how to do that. Most people include the children on the original petition even if they intend for them to "follow-to-join" within the year time frame. That is what we did. I am sure there will be someone here that can advise you how to file a new petition for the children if that is what you truly need because they were left off the K-1 petition.
