IRS lost my husband's 2005 tax return

It's hard to believe but yes, the IRS seemed to have "misplaced" the tax return which Rob sent out in April. We only found this out 2 weeks ago when he tried ordering tax transcripts for our interview in August.

We know that the documents got to them because the IRS sent me my ITIN on May 16. The instructions for applying for an ITIN starts with: "Complete and attach Form W-7 when you file the tax return for which the ITIN is needed." And that's what we did! We needed the ITIN for the 2005 return since we got married on August 2005 and wanted to file jointly.

So I guess someone decided to process our ITIN application and throw out the rest of the stuff - 50 pages worth of paperwork on his return (he's self-employed and is very meticulous about making sure things are documented really well).

Rob naturally tried to track everything but the only thing the IRS agents would say to him is to refile. Well, that's going to look like he filed late which is really annoying because he is never late with these things. After a couple of days of just trying to figure things out, he decided to send in his return (again) with a letter (and proof of delivery from the first time he filed) explaining what happened. This was June 30. We'll have to see what happens.

Meanwhile, he doesn't think we'll get a transcript in time for our K-3 or CR-1 interview. Do you think they will accept photocopies of what he sent them instead of the transcript?

Try calling the ITIN office 1-215-516-4846 since you know it made it that far.

Yes, he also called the ITIN office number... that very same one because that was on the letter I received from them. And he said, they couldn't help him either. They kept on telling him to call the automated number for refunds which of course does not help.

Did the IRS date-stamp your tax form and ITIN application and give you a copy of it?

I sent in copies of my return instead of the transcript and that was accepted. I am sure copies of the papers he submitted to the IRS would be fine.

No, they did not give me a copy of a stamped ITIN application. They just sent me a letter saying that they have assigned me an ITIN. In the letter, they gave me the ITIN and a case reference number (which my husband referenced when he called them). It seems that wasn't much of a help either.
