RE-AFFIRMED K1 PETITIONS

I have searched 'high' and 'low' and have only found a handful of others (no exageration here) in the same boat as I am. It's obvious to me that we really need to have somewhere where we can gather and share each others stories and hopefully learn something about re-affirmed petitions and what is to be expected. I almost feel like I'm all alone here. I posted in someone elses topic on this very same subject (re-affirmed petitions) where I thought it may be of help to me and 'for' others, but it just went sort of dead. So..if there's anyone out there who is going through this too, then please post here, and OFTEN to keep it alive.

Here's the story...

My K1 petition was orginally approved on May 22, 2008. It went through the whole process, interview and AP. Then it got reuned because of the CO not being (of course) convinced.

Well, I went to India, was going to get married there, but there were some document issues that I didn't know about, so we didn't get married (I'm thankful to God in Heaven for that too!). By this time, we decided that I would move to India as we were tired of the waiting and just wanted to be with each other, even if it meant me moving there instead of his coming here.

'BUT", when I arrived home all prepared to make the arrangements for the move, I had the letter from USCIS stating that they had reviewed our case and are standing by their original decision of approving my petition for fiance (K1).

My petition was re-affirmed with a brand new validity date and right back, it seemed, to square one. My belief is that God had answered my prayer.

So....here I am, seeking and searching for any and all information on re-affirmed petitions and wanting knowledge from VJ'ers and most specifically those who are going through this same process. Even if someone 'only' knows of someone that's been through it, please share their story.

Thanks in advance for taking the time to read.

There are others in your situation, and the messages do seem scattered. I will refer your compelling story to Captain Ewok with a suggestion that a subforum be established, perhaps in the Waivers or another main forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Thank you TBoneTX,

Appreciate your help. Information on re-affirmed petitions really are scattered around and thats why I posted this, to try to get the attention and have someplace where we could gather to try and learn what we could about this seemingly rare process. I'm just totally lost because I'm hardly finding info on reaffirmd petitions anywhere. And the embassy doesn't supply us with information on this either, just their reason for assigning the new case number, but not the process itself, ie, like do we need to re-submit all the documents we had submitted the first time around?

After waiting 14 days for the "packet 3' (the Embassy said they mailed it on Aug. 10th), I sent them another email informing them of this, and then in return sent me an email 'attachment' of the DS-230 and Applicants statement with only the message that they would schedule the interview after they recieved these filled out and signed forms.

Well, as you know, the packet 3 has a long list of all documents required 'before' submitting the Applicants statement / or rather your acknowledgement that you have the listed docs in your posession. There were no listed docs in their email. There has been no request for the local or passport PCC's, Medical Exam, or any other instructions. And since it's been a year 'today'(Aug. 25th) since the orginial interview, I would think that they would want these, since it's been more than a year.

I've emailed the Embassy 3 times with the answer that once my fiance submits the DS-230 and Applicants statement, they will set up the interview. Thats it, nothing more.

So, you see, I'm wondering what in the world is going on?

To date, we still haven't got the packet 3 the Embassy says they mailed on Aug. 10th (I requested that they please mail it again but no reply to this).

Since my reaffirmed petition expires on Oct. 04, 2009, I mailed a letter via UPS requesting that they extend the validity to give my fiance additional time to prepare. (According to ups tracking, they recieved the letter today). I hope they will.

At this point, I don't know what to do more or even what to expect. I'm totally cluless.

Thanks again, for your helping.

Also, my fiance filled in and signed DS-230 and the Applicants Statement. We submitted them from both our emails and as well mailed them by registered mail which the Embassy should recieve no later then tomorrow (Aug. 26). Will update when we get a response from them with any further instructions. Hopefully, they'll be more speciific, or 'clarify' for us what we need as to the other docmentation that are originally requested prior to the first interview.

I just wish they weren't so evasive.
