Hi guys,

We are about to send out the AOS package. We have one question, since we rushed in all this, spontaneous wedding (but very romantic and still the first and last one for us!), about the affidavit of support... (if spelled correctly)....

My husband just graduated from college and started to work 4 weeks ago. Is it sufficient that he gets an employer letter where they explain that he makes enough money (it is well above the poverty line, but he just started to work though, so no tax returns)? Did anyone have the same situation?

I don't think so. You will need to show that he made enough money in 2005 (last tax year). If he didn't you will have to find a co-sponsor.

You are adjusting status from a K1?

If you are, he must've used a co-sponsor to bring you here. If it's ok with the co-sponsor, you can do both, use your husband's employer's letter and the co-sponsor (updated) information.

You need at least last year's tax returns to include with your Affidavit

No, one does not necessarily need to show that they made enough money in 2005 (although if they did it would strengthen their situation). More important is does one make enough money today and are they likely to continue making enough money in the future.

Not really.

It's more important that the sponsor meets the criteria at the time of the AOS process. Having a history of acceptable income (from previous years, i.e. 2005) would help though of course.

25 March 2006 - Mailed AOS package to Chicago! (I-485, EAD, AP)

28 March 2006 - AOS package recieved (day 1)

4 April 2006 - I-130, I-765 (EAD) NOA date by USCIS. NO AP, yet. (day 7)

6 April 2006 - Checks cashed (NOT AP)

7 April 2006 - I-130, I-765 NOA's recieved in mail! (day 10)

10 April 2006 - I-131 (AP) RETURNED. Should have mailed it to Nebraska Service Center <confused> (originally sent it to Chicago Lockbox with AOS..) (day 13)

13 June 2006 - Interview. "not concrete approved", received two emails later same day approving I-485 and I-130. "welcome notice was mailed" and "approval notice was mailed"

17 July - I-485 Welcome notice received and I-130 approval received

18 July - I-485 "after approving your application, we ordered you a new card" email received.

24 July - GREEN CARD RECEIVED! All info correct. Apply to lift conditions 7/13/08

Thanks a lot...

No we didn't apply for K-1, I came here to work which was convenient since my boyfriend (now husband) is here. But then after a couple of months he proposed and we got married, so we do the AOS now. He attended college and graduated in June and started to work right away.

So he makes now way more money than they ask for, only that we don't have old tax returns since he didn't work back then!

But I think it's fine now, since you can write a letter why you don't have old tax returns and they should understand the situation now... I hope!
