Hi to all VJ family,

I am trying to be strong... I am a victim of domestic violence. At first I experienced a verbal abused.. but later on it went into a physical abused.Last two weeks my husband got arrested ,and went to jail for the grounds of domestic abused, he punched me on my face while he was driving.. he had always a bad temper .. since we got married 1- 1/2 year ago. I am trying to console myself that he will gonna change... but I had enough... I called a police that time when he punched me on my left face..

and the police officer interviewed me about what happened. I said its not the first time that he hurts me.. last time he kicked me on my back while he's trying to stop me for appying for a job through the intenet. We both got laid off last month. He said "just wait for my EDD claim first..."before u apply for a job... i don't know why he had an attitude like that.

Now I am with my friends house.. because I filled a TRO(temp restrining order) against him.

We just renting a room so I am not safe to go back on that apartment. My friend said that my husband was already bailled-out after 24 hours on the jail.

Last time i received an email telling me that my husband was planning to fill a divorce.. and he's threatened me he will go to immigration to report that i'm not with him ...to deport me.. ( I don't wanna stay with him i am not safe .. so i hide on my friends house)

He's currently under TRO..

I am worried right now, I am asking your help about my situations, though i know I have the rights as a read under VAWA (violence against womens act).

But I don't have a job right now, to hire an immigration lawyer to apply for a vawa petition.

I don't know what's the best step to do?

Can I fill-up application for vawa petition or self- petition? to remove my condition right away.. my 2 years conditional visa will be expire next year?

Find charities in your area that may have pro-bono lawyers who can assist you. You can try through the Catholic Church or some of the abused women's shelters have information on who may be able to assist you...but you should consider filing for a divorce as well. You should also keep all documentation of you calling the police and having to place a restraining order against your husband. These will be used in your VAWA petition as proof of the abuse.

The police and court should have provided you with contact information for free services. If you do not have them, google your location and "domestic violent services." Start calling around until you get connected to the proper networks. There are many free services available. Here in California, you can get legal advice, shelter, food and counseling. I strongly recommend going to a support group. Don't let him control you with fear - he's done enough damage. Take care of yourself.

Sophie,

You don't even need to wait to file for a divorce..you can apply NOW to remove your condition especially with your harsh abuse, i think your case has a great chance for approval due to the amount of evidence (the numerous police reports) and the extent of physical abuse. There has been approvals for spouses under psychological abuse that were approved merely with psychiatrist's reports.

With all due respect to your husband, i think only a douche bag would hit a woman. Please be safe.

hi sophie,

do you currently have a green card? Since you were applying for a job I assume you do. You do not need to apply for VAWA. Please finalize your divorce and keep all the documents to prove your marrige was bone fide. Even if your husband doesn't let you to have any documents all you need copy of the police report and restraining order. File for ROC based on abuse and you are good to go. His threats are empty he CAN NOT do anything.... Stay strong....

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
