I got a RFE, but my case is pretty complicated

Those letter above are the exactly letter that I received. USCIS is requesting the same evidence that I sent in the first place. I can provide all the evidence regarding my person, but I will have a hard time to get evidence from my wife's sponsor. He was a my manager for years and recently he got promoted and transferred to other store. Also, he'd a new girlfriend that was pretty weird. I sent the papers on august first. My co-sponsor was arrested on august 3th for possession of illegal drugs. I wasn't aware of those activities otherwise I wouldn't asked him in the first place. I'm not sure all bad that affect my case. All I know is that he isn't working right now and still waiting for a trial. What should I do? I can try to reach my co-sponsor for the evidence, but I don't know if is going to cooperated since he is in a bad situation. This visa process has been the biggest nightmare of my life, and when I thought that everything would be okay my co-sponsor does something like that. Thanks for your time

OK - you're adjusting status from a K-3 (after having to go back through some of your previous posts - a timeline would be very helpful by the way).

Is it safe to assume this RFE is just for your Co-Sponsor? Any chance of finding a substitute co-sponsor?

Yes, the RFE is probably because of him. My evidence was 100 % clear. I can try find other sponsor but It's always a hard thing to do. My dad was my original sponsor but he passed away last year but I'm about the receive my heritage in 2 months or so. With the heritage money I can make the difference to sponsor my wife. I made $16,000 last yr and I need to have $11,065 to make for the difference. Also, my wife received her biometric appointment. I appreciate the help.

Without fully understanding what was originally sent - it sounds like they (USCIS) is asking for:

  • Supporting documents for either the Sponsor (the US Spouse) and/or the Co-Sponsor
  • Birth Certificate/proof of US citizenship of the Co Sponsor

At a minimum.

I'm going to list all the evidence I sent.

Wife's I-94/passport

My taxes for 3 yrs

my co-sponsor taxes for the past 3 yrs

a copy of my ID

copy of my co-sponsor ID

my wife birth certificate translated/original and my married translated/original

evidence of current employment for me and my co-sponsor.

I've a question. is there a way to replace the co-sponsor? If so, how can I do that?

Is your inheritance that is coming in two months gonna be a substantial amount?

My understanding is - you could submit an alternate co-sponsor along with a brief letter explaining you were unable to obtain the needed items for your original co-sponsor (of course along with any other items requested in the RFE plus the original RFE notice).

Can't it be a state ID? that's what I sent.

State ID not good enough - needs to establish citizenship.

Proof of U.S. citizen or national status includes a copy of birth certificate, certificate of naturalization, certificate of citizenship, consular report of birth abroad to citizen parents,or a copy of the biographic data page of your U.S. passport.

I'm receiving about 20,000 in cash that should be able to for it, right?

$ 20,000 will cover about $6,600 of your shortfall, how many people are you counting in the household. I can't find any poverty level figures to match you amount of $27.065 on the charts.

Multiply by 5

$11,065

that's the amount of money that I think I should have, correct me if I'm wrong, Thx for all the help.
