Hi to all VJ family,

I am trying to be strong... I am a victim of domestic violence. At first I experienced a verbal abused.. but later on it went into a physical abused.Last two weeks my husband got arrested ,and went to jail for the grounds of domestic abused, he punched me on my face while he was driving.. he had always a bad temper .. since we got married 1- 1/2 year ago. I am trying to console myself that he will gonna change... but I had enough... I called a police that time when he punched me on my left face..

and the police officer interviewed me about what happened. I said its not the first time that he hurts me.. last time he kicked me on my back while he's trying to stop me for appying for a job through the intenet. We both got laid off last month. He said "just wait for my EDD claim first..."before u apply for a job... i don't know why he had an attitude like that.

Now I am with my friends house.. because I filled a TRO(temp restrining order) against him.

We just renting a room so I am not safe to go back on that apartment. My friend said that my husband was already bailled-out after 24 hours on the jail.

Last time i received an email telling me that my husband was planning to fill a divorce.. and he's threatened me he will go to immigration to report that i'm not with him ...to deport me.. ( I don't wanna stay with him i am not safe .. so i hide on my friends house)

He's currently under TRO..

I am worried right now, I am asking your help about my situations, though i know I have the rights as a read under VAWA (violence against womens act).

But I don't have a job right now, to hire an immigration lawyer to apply for a vawa petition.

I don't know what's the best step to do?

Can I fill-up application for vawa petition or self- petition? to remove my condition right away.. my 2 years conditional visa will be expire next year?

Your response will be a great help for me..

it is only my opinion dont go back to him and u can remove the conditions on ur own and get divorce, if he try to do any more harm just call 911.

no one deserve that kind of abuse, wish u all the luck, there are so many people on this site they will give u a better directions, abby n sheryl

Our time line for CR1 visa took only 5 months and 1 week or 156 days; from the filing the I-130 on the 03-12-2009 to Approval of NOA2 on the 05/13/2009, then Interview on the 08/18/2009 at Manila, Philippines. We had a daughter on the 11-12-2010 named AISHA JOY means HAPPY LIFE.a1_opt-1.jpga2_opt-1.jpga3_opt-1.jpg

He cannot get you deported. Stay away from him and keep the records of abuse. As soon as he divorces you you can apply to remove conditions and get your 10 year GC. You shouldn't have any problems getting it with records of abuse.

When does your GC expire?

My 2 years GC will expire on Sept. 2010.

I will go to Court to apply for Permanent Restraining Order, for my protection

but still I'm very frightened, I don't want to go back to him anymore ...

I already have a copy of police report..

You can apply to remove conditions if!

2. You entered the marriage in good faith, but the marriage was later terminated due to divorce or annulment;

3. You entered the marriage in good faith and have remained married, but have been battered or subjected to extreme cruelty by your U.S. citizen or permanent resident spouse; or

While you are at the court house ask for the initial documents required to file for divorce. In California it doesnt matter who files the papers. The process of filing isnt too hard & if you need help there are many places to get help. You dont have to have a lawyer, however you might find a family law lawyer in your area & sit down with them to seek advise. You should find that your husband has to pay the legal fees as a result of having you immigrate to become a victum of his violence.

I would encourage you to do this as soon as possible. Knowing what protection the law affords you under the circumstances should give you some peace of mind.
