I filed an extension on our taxes in April, mistakenly thinking that my husband had to show "substantial presence" in 2006. Now we are scheduled for AOS interviews (K1 & K2) at the end of this month, so we are not likely to have our return back in time. As the date draws nearer, I am becoming more apprehensive about this.

Has anyone gone through an AOS interview without the previous year's tax return? Is it likely to hurt us? Do our W2s mean anything? Is there anything else we can do to help ourselves?

Thanks in advance for any advice/experience that anyone can offer. And thanks also to the 50+ people who tried to read this post the first time I tried to post it. The topic showed on the board, but the original post wasn't there!?!?

at this point you should have allready provided a affidavit of support we were never even asked for it at our aos i wouldnt worry about it just take all info about it but dont say or provide anything unless asked....just give them what they ask for and keep your mouth shut..i found that was the best...just be prepaired with all you can possibly have..what more can you do???

How did you file you taxes?? Don't you have a copy of what you submitted to the IRS?? We do our taxes online and it gives you a printout at the end (the same thing that is sent to the IRS).

The automatic extension gives a taxpayer until August 15th to file, and if your interview is prior to that, technically, you shouldn't be required to provide it. If you have already file the return, you can take a copy of the 1040. If you haven't filed by your interview date, but you kept a copy of the 4868 extension form, for the extension, take a copy with you.

Hi, my husband and I gonna have an interview on July 24, 2006, we filed for extension as well. My husband does that every year, we dont' know what gonna happen to us on that day, if we have some problems or no problem at all, we're willing to share with you. Pray for us. And I think it's a very good idea to keep my mouth shut until they ask. And I will ask my husband about the confirmation of that extension as well. Actually we were requested for the proof of income before we got an interview appointment. My husband sent W-2 2005 and explaination letter to them, they accepted it and issued me the EAD card and the appointment date. I was worried about that before but my husband told me that it should be fine, because they already accepted that in the first place, why they have to reject us at the interview. If it were not good, it could have been rejected in the first place. Anyway, something could happen on that day, the worst case is: if they need to have that, my husband has to file it as soon as he can, otherwise we have to have the most suffer time again. We don't want to have that for sure.

Please pray for us. And don't worry about that, our case is a study case. We never try, we never know. :lol:

We will share with all your guys, when we come back from our interview.

The approval of an AOS case does not hinge on the issuance of an EAD, but if the additional tax return were required at the interview (I'd be surprised that an AO would demand it, but anything's possible) then chances are the decision might be delayed and would be predicated on providing that. Good lcuk, all the same.

Thanks all for your replies!

Pat, I'll definitely be praying for you and waiting to hear about your experience as your interview will be just 3 days before ours. I would think that a W2 would be just as good for proof of income as a tax return (unless perhaps one is right on the margin and one's actual tax owed brings one's income level to just below the required amount! :huh: )

At any rate, I'll take all the other documentation I have (paycheck stubs and copies, W2's and copies, and maybe a new employer letter just for kicks).
