Question on Income/Affidavit of Support

hey guys, i'm fairly new here and this is my first post.. From what I understand, including the past THREE tax returns is a requirement for the Affidavit of Support. Anybody know if this is absolutely a requirement?? Here's my situation: I received NOA1 on 7/14/09. I recently graduated medical school this past May, and am currently a doctor in residency training (started working on 7/1/09). I am 29yo, and have never filed taxes, as I've been a student practically my whole life. I figure, with the way the timelines are heading, my SO will have her interview some time in January. By then, I will have about 6 or 7 months of pay stubs to show..... but that's about it. Does anybody know if this will satisfy the requirement? I'm just trying to plan ahead. I'm not sure whether or not I should just get one of my parents to agree to be a co-sponsor. If anyone else was in a similiar situation, and have advise, I would be grateful. Thanks!

Three years worth of tax returns (and supporting documents) is not a requirement - the most recent year is.

Some folks, if they have them, submit additional returns if they feel it will help them, but it isn't necessarily required.

ok, but i don't even have a "most recent year." as i've stated, I just started working this year, and have never filed taxes. anybody know if pay stubs alone are enough to prove income? thanks!

You would simply need to write a letter of explanation as to why you did not (or were not required to) file taxes for the most recent year. Income will be calculated off your pay stubs.

congratulations on your residency! you might also want to get a copy of employment from the hospital you are working in stating your annual income and when you started working there and if your temporary/permanent fulltime or not, that sort of thing...my income for last year did not make the 125% above poverty line because i only started working in august of 2008 but the annual income of my job meets my requirement. so when i applied for AOS for my husband, i sent a letter from the place where i worked. I also explained that I have not filed for the previous years because I was still a student...best of luck to you...you sound kinda familiar?

Just a thought, but in your situation I am guessing; a hospital, if they have an e-pay site or if your paychecks are electronic then perhaps you can go to the website and print the paycheck stubs of what you have, then if they provide it print off a report of your total income so far this year.

Ok, so I will definitely be drafting a letter of explaination. oh, and i never thought to ask the hospital to make a letter verifying employment! thanks for the suggestion. i will try asking the Director of my program, and inquire if that is possible. Seems that we have the same timeline. Got our NOA1 last July 15, and we are also preparing ahead of time. I think a bank certificate or a letter from your bank will do. Your medical license (an ID or whatever certificate) is an option also...it might help =)

I have read on a number of posts here that K1 applicants from Manila have been refused a visa because they have a co-sponsor. The Embassy is more lenient towards an applicant having a co-sponsor if they are applying for K3 or IR1/CR1.

Just wanted to be helpful and give you kababayans a heads up so that all your time and hard work on the application is not wasted.

More specifically, USEM doesn't react well to co-sponsors who are not related to the petitioner.

I'd get one of your parents to co sponsor. letter from employer, bank statements, do a letter of explanation why you didn't file taxes and

ATTEND THE INTERVIEW.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
