Bring 18 years old daughter to US.

I petitioned for my Mom and she came in on October, 2008. She is a LPR. I didn't petition for my sister because the process was going to take 12 years. Is it better for my mom to send the petition now, or wait until she becomes a US Citizens in 5 years?

Have your mother petition for your sister right away. An LPR can petition for an unmarried child under the age of 21 (F2a family preference category) in about 4.5 years. Visas are currently available for F2a cases filed before April 15, 2005 (except for Mexicans).

In 4.5 years, your sister will be over age 21. However, she may not age out because it depends on how long it takes USCIS to approve the petition. The reason is that under the Child Status Protection Act (CSPA), the time it takes for USCIS to approve a petition does not count against a beneficiary. Early approval is bad. If the approval takes 2.5 years, your sister would definitely get a visa in 4.5 years. CSPA age = real age when a visa becomes available in 4.5 years - time it takes USCIS to approve the petition and send off to the NVC to await for an available visa in that category. The longer it takes USCIS, the better it will be for your sister. Your sister cannot be married; marriage voids the petition.

She should file now and upgrade when she gets her citizenship. You should both file in case one of you die . Death voids a petition.
