I-134 I-864

I'm a bit confused about these two forms...are there certain types of people who get either of these forms? I mean...what are the factors in determining whether or not you will receive either form? In other words, who is more likely required to fill out the I-134 and I-864? Thanks for any replies.

I-134 is an affidavit of support use for K1/K3 processed while I-864 is for AOS (adjustment of status to LPR)

But you should take a look at the poverty guidelines that come with I864, because they apply to I134 too.

Ok! thanks! that makes perfect sense now...just wonder why it wasn't clearly stated on those forms..but oh well.

They don't? Could you please elaborate? If the guidelines don't apply to I-134, what do "they" look for other than what's on the form?

whilst the FAM states that the 125% of the poverty guidelines doesnt apply for the I-134 as it does for the I-864.......many consulates elect the 125%, but not all. Whilst the K visas are non immigrant visas, they are processed in many ways as an immigrant visa.....the fact that one will be applying for residency once in the US where the 125% will be required with the I-864 when one applies to adjusts status. The I-134 does not have any percentage of the poverty guidelines attached with it and is only one thing that a conof may use to determine if an applicant will or wont become a public charge.....hence also why other things aside from what the I-134 states, is often used.
