WOOHOOO CR1 case will be forwarded to Frankfurt

Hey guys,

I just got off the phone with NVC. Yesterday I talked to a really nice lady from the Frankfurt consulate and she told me that she will try to get our CR1 case transfered to frankfurt to process it. God I am so happy!!

So now I am really curious how are the steps for Consular process in Frankfurt for a CR1?

Any advice? Isabel

06/14/06...I-130 approved via email [day 111]

06/19/06...NOA2....I-130 received via mail

07/10/06...talked to embassy to expedite the process

07/12/06...NVC stated case completed and sent to FRANKFURT[day 147]

07/17/06...received packet 3 from embassy

07/29/06...received packet 4

08/15/06...INTERVIEW at 7:30am- APPROVED

08/21/06...VISA received

08/23/06...Flight to US

08/23/06...I am back home

09/20/06...received greencard in mail

09/27/06...received SSC in Mail

09/23/07...our daughter was born :)

30/05/07...filed for Removal of Conditions

07/05/08...received NOA for I-751

01/07/08...college here I come :)

Great News! Maybe contact the Embassy at Frankfurt for the next steps.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Well I think it is very confusing for you guys.

First off we filed the I-130 through USCIS in America. So when our I-130 was approved it was sent to NVC for processing. But since my flat was cancelled and my work also; I called Frankfurt what I could do. And this nice lady told me to cancel that K3 and persue the CR1 and that she can also try to get the CR1 transfered to them, so they can process it. Since that would be faster. MAybe you guys get my point here. Now I really wanna know what the DCF is like in Frankfurt after the CR1 is approved.

Indeed it has been a bit confusing for us, perhaps because I think you've got things a bit backwards here.

DCF is filing one's I-130 petition with a consulate (or with an overseas USCIS office) rather than with a domestic USCIS Service Center. You filed your I-130 with the VSC. It's been approved, and not by DCF.

The immigrant visa application, in your case a CR1 visa application, has not yet been approved. The application will be made (has already been made?) to the NVC and will be forwarded along with the approved petition to the consulate in Frankfurt for interview.

The lady asked me if I already have the information packet from the NVC and I said no. And she knows that the I-130 hasnt been processed at NVC yet. THATS why she is tranfering the case to FRANKFURT, to speed things up. That is exactly what the POE officer told me a while ago. Sometimes the Embassy does you a favour and processes your I-130 instead of waiting for the NVC to do it.

The I-130 is approved. There is no further processing to be done on it. Now it's time to process a visa application.

It will be interesting to see if you get to make your visa application - submit DS-230 and I-864 - directly to US consulate in Frankfurt or in the usual manner to the NVC. I'm not going to bet against you on that, but I'm not going to bet for you, either. Just gonna sit back and see what there is to be learned from your case.

Yah no kidding. I am interested in that as well, since it didnt seem to be happended here before?! It is so unusual that I am totally confused about it either. Since even the NVC told me...well not possible and after i called back a few hours later they told me....your I-130 will be send to the embassy. I am also confused. I will keep u guys updated. I'm not sure why the Consulate would make such a promise to you for your particular case if there are no pressing, extenuating circumstances. It's just odd.

I can't answer your questions on how or where to proceed now because it seems as if your case will be a mix of immigration visa processes.

If what you are saying is true, then you will have filed your petition in America and completely bypassed the NVC even though, as I understand it from the information you've given, your husband is not currently in Germany nor is he a resident in Germany. Usually that is what is required, among other things, to file your petition and subsequent immigration visa application in Germany.

If you proceed now as if you're a DCF case, then I imagine you'd receive Packet 3 soon, which would include medical exam information, Affidavit of Support instructions, and the Immigrant Visa Application (DS-230). There are some other leaflets worth reading as well in the Packet. There will also be a checklist (OF-169) that you should fill out completely and fax back to the Consulate along with the biographic information page in your passport. You should mail the OF-169 as well as the Checklist. (That's what I did and it seems to have been okay. I wasn't sure if I should mail both documents, but I did just to be safe.) In a week or so, you should receive Packet 4, which will list your interview date. A medical exam appointment may also appear on this letter, but you can disregard that if you've already done your medical exam in another city by a Consulate approved doctor. Generally, the process at the Consulate, in my experience, has taken about a month if you send back Packet 3 quickly and completely. Take a look at my timeline, particularly when I received Packet 3, when I sent it back, and when I received Packet 4.

Do keep us updated on what happens.
