FBI background checks on the PETITIONER???

Can someone please make this more clear for me...

I am lodging a CR-1 application, I am the beneficiary and I am not from the USA of course.

Is there to be an FBI check on my USC husband even though he is the petitioner and I am the beneficiary??

I thought, and was under the impression, that they just wanted MY police check (from Australia) and not a check on him too??!?!

I read a couple of posts elsewhere on here mentioning that the FBI checks were "Holding up the USCIS process" or something like that....

Does this happen, and if so, will it affect the NOA2 coming if my hubby has had a DUI in the past? I know it seems silly to ask, but I thought the police checks were done from my end, because I am the one moving there...

p.s. i just found this post http://www.visajourney.com/forums/index.php?showtopic=210613 and i was wondering, is a DUI something that is picked up in this kind of check? would it cause delays? i guess you guys might not have the answers for me.. but i didn't even know there were FBI checks done on the petitioners.... but i guess it makes sense if you are married to a serial killer or something (hehe) not that they would be roaming around free mind you

Everything is on public record, so yes a DUI will be found on petitioner and beneficiary if they were once here in USA. A DUI should not at all effect the case on him, especially you since you are the beneficiary.

Dont worry, it will be fine.

FBI cleared out alot of the back log, and not taking as long as they use to.

Check are done all thru the process on petitoner and the beneficary from USCIS to NVC to the Embassy.

I don't think I'd worry to much about his DUI, really... I think his main concern is the Affidavit of Support process, you know? If YOU had the dui and such, it could pose a problem but honestly? I think it's fine that it's him, the USC and not you....

Hope it's going well and that the waiting isn't gettin' you down. If it makes you feel any better at all, I'm waiting for Montreal to schedule us an interview and I am back to the feelings I had waiting for the I 130 approval, like it's a black hole of not knowing.

Montreal is a really slow consulate despite the fact that most of the spousal visa petitions going through it are easy -- we're not a high-fraud country. Montreal is, and this may be the problem, the only consulate in the country that processes this kind of visa.

So, just trying to ensure that you don't feel alone in the waiting process...

Unless your petitioner has a serious criminal record (esp Adam Walsh act issues), they don't really care about his record, a single DUI certainly won't cause problems.

thanks to everyone else who replied here and made it more clear for me. i really appreciate it. i have a habit of stressing about things before they happen.. but i know i will be honest and open with the immigration folks and i will hopefully not come into any issues from not being open.

lucky i have a squeaky clean record hehe. its just hubby who is the bad boy
