OK, first, sorry in advance if this is the wrong section for this topic....I don't know where it actually belongs

A member of this forum informed me that at my fiance's POE, he will have to register with NSEERS (link here: http://www.ice.gov/pi/specialregistration/) because he is a Pakistani citizen entering the USA so this registration is mandatory for him.

But now that I have looked into the information given on the ICE website, I am reading it as NSEERS is only mandatory for non-immigrants who are going to stay in the USA temporarily....so this DOES NOT apply to my fiance since he will be entering on a K-1 with the intention to stay in the USA permanently after we get married, correct?

As far as i know he will not have to register. Do make note that he is required to provide an AR-11 change of address within 10 days of moving if he moves. This is how they keep track of the immigrants.

I do not know whether he will have to do NSEERS registration, but I think your reasoning is not quite right. NSEERS registration is required for certain people entering the US on non-immigrant visas. The K1 is a non-immigrant visa. I don't think it matters that he intends to adjust status and remain.

The K-1 is not classified as a non-immigrant visa according to the US Embassy in London, the embassy processing my fiance's K-1.

Also, ICE states:

"There are two categories of U.S. visas for foreign nationals entering the country. Immigrant visas are issued to foreign nationals who intend to live permanently in the United States, while nonimmigrant visas are for foreign nationals wishing to enter the U.S. on a temporary basis K-1 is not for entry to the USA on a temporary basis, it is dual intent visa: to marry the USC and live permanently in the USA – whether for tourism, medical treatment, business, temporary work, study or other, similar reasons.

Those who fall under the second category – nonimmigrants – must also adhere to the National Security Entry-Exit Registration System (NSEERS) also known as Special Registration, put in place after September 11, 2001, to keep track of those entering and leaving our country in order to safeguard U.S. citizens and America’s borders."

NSEERS is just another interview with more detailed info required and recorded from citizens of certain countries. I have travelled to the US alot post 9/11 and have gone through NSEERS each time I entered. Even if your fiance has to go through it, it will just be an inconvenience of 45 minutes at the airport, where they register you, ask a few questions, jot down your credit cards and stuff. But since he is coming on a K visa, I am sure he doesn't have to go through the NSEERS since he has already been grilled enough during his K visa interview.
