Am I justified to make an infopass since its been more than 30 days now since my AOS interview and I have not heard from the USCIS. There have been no online touches either. I know many here have had issues with delayed decisions, but when do you think I should approach them. Many topics here have quoted a 30 day window, and some have stated to wait for 60 days before approaching USCIS. I have placed several calls(despite the fact that I know they are useless) to USCIS hoping they might have any updates or might guide me on my next course of action. According to USCIS, my local office is processing Oct. 2008 cases and I am well within my timeframe. What sort of a bull**** story is that. Any suggestions and if so, how to best address my issue?

I'm really sorry you are still waiting for a decision! From what I gather in your case you sent in the extra info they wanted after your interview. If I were you I'd definitely make an info pass appointment. In my interview they guy said if I don't receive my card in the mail after 90 days make an info pass appt. But it seems everyone is told a different number. The worst they can say is " no wait a little longer". This is your life and future in this country. We all know what it's like to be on edge so do what you can!!

Thank you recentlymarried. I just thought, i am scheduling an appointment a bit soon, since there have been people who have waited for years for any concrete response from USCIS. I have an appointment for the 25th of August. Lets see how it goes. I had submitted the documents the third day of my interview.Wasn't much in the document to verify, since it was the original divorce decree the IO wanted to see. Unless the IO just put my file away somewhere in the drawers and forgot about it.

You are right Septembergold. Though, I have little faith, since these IO's watch each other backs, atleast i would have let it off my chest. Will keep you posted of the outcome.

Ack. Still waiting. :( I look just about every day to see good news from you!

It certainly won't hurt you to make the infopass appointment, and at least you'll know where you're at. Even if they can just tell you they've received it and are still reviewing things, at least it's something. And if for some reason they've forgotten you, there you are to remind them. :)

I really think that good news will be coming for you, but my heart does go out to you. Keep your chin up and keep us posted! I know you will. ;)

Hi All,

Just as I expected, the infopass had nothing to offer. I reached the Local office at 11:30AM and after showing the Infopass letter, I received a ticket and waited for my turn. After about 45 minutes my number was called and I went to the designated counter. There the lady said that the Officer ____ hadn't reached a decision on my case. I asked if the documents that were asked of me during the interview had reached my file since I had submitted the originals in person. Her reply was that they must have, otherwise my case would already be denied. Upon asking when a decision would be expected since a month has already gone by, she said, I could check back in a month if a decision has not been reached by then. I thanked her and left.

Now what???!!??? :protest::clock:

At this point you can't do anything else, but wait for the CO to make the decision.

You have your EAD/AP- right?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

You are right. But its frustrating!!!!

I do have it, but I don't want to use the AP and go back home only to find out that I have been called for a second interview in a month, or worse, my case has been denied. Not to mention we are planning to move to Texas, and I am simply waiting for the outcome of the case to start packing. Haven't started looking for a job for the very same reason.

Thank You trillium13. I guess I'll just have to wait and see. Am planning on placing a service request tomorrow as well over the phone. I have been working on moving to Houston for quite a while We were just hoping that our AOS case would end sooner, but it kept on stretching. Then came the pregnancy. Now that the baby is here, and interview conducted, I told my wife to quit her job. So, with no job, NY is a bit too pricey. I was planning on buying a house and start my business in Houston. Houston/Dallas suits me that way since I have lots of relatives there who can atleast guide me in the right direction and be there for moral support. I'll keep you posted on the outcome of this stupid issue.

The IO had asked me about my accounts and property details back home. I provided him with the details and documents. And since the on-going war against terrorism, my country is not in such good books and too much in the limelight, I have a feeling, they are checking into my financial/asset details back home to ensure its all legit. I have no worries, but they should atleast have had the courtousy to let me know or give me a timeframe to work with.

Your good vibes are definitely needed at this point and time.

Interesting...I also moved from NY (upstate) to TX. My husband was living here when we met so I moved down to be with him. Not loving this area particularly, but we are considering some other areas of Texas as well.

Sorry to get off topic, just an interesting coincidence. You won't miss the winter, I'm sure. ;)
