Im Canadian my fiance American. We will be applying for the K-1 visa mid Sept. This is my question. I live in Vancouver. I was wondering since I can legally stay in the usa for 6 mths I go to visit him lets say end of january. Could I stay with him while its being processed as long as I go back before the 6 mths is up. And is it possible to go for the interview in another Canadian city? Thats closer to my fiance? he lives in Baltimore.

Many Canadians visit the US to meet with their fiance during the K-1 process. The key is to have a lot of proof of your ties to Canada when trying to cross the border. If you come to the Canada Forum, you'll see some threads of people's recent experiences. For a few Canadians lately, they have actually had trouble coming in for six months. They have been given a stamp on their passport saying that they have to be back in such and such time, and are actually given a date. I think about 3 months? Anyway, you can't if you come down overstay past the date they give you, IF they give you a specific date to return. The links I provide you will have information as well on what proof of your ties to Canada you need to successfully enter the U.S. While it is true we can visit up to 180 days, it is also at the discretion of the Border Officials.

Since you're living in Vancouver, you'll be interviewed in Vancouver. There are only two places in Canada where there are K-1 interviews and that's at Montreal and Vancouver. There are MANY Canadians that WISH they could be interviewed in Vancouver! The timelines for interviews in Vancouver is MUCH quicker, so be thankful! You can shave off probably on rough estimation about 3 months of wait time if you're in the West and applying for a K-1.

As far as i am aware, you can petition whilst in America, but you must be in your own country for the interview.

As for the interview, I know in Australia that it's only done at one embassy, but I also know that on the K1 petition form you can put the processing town, so I'm sure that'd help. Why does being in another Canadian city closer to your FH matter? Won't you just fly to him afterwards anyway?

I think this post just confuses me a little. The process MAY take longer than the 6 months anyway, and I know in Australia that the Visa is posted out, not given there and then so you'd need to go back to your home to grab your stuff (inc the visa) and then leave to be with him.

January 28, 2009: NOA1

June 4, 2009: Interview - APPROVED!!!

October 11, 2009: Wedding

AOS:

December 23, 2009: NOA1!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

March 15, 2010: AOS interview - RFE for I-693 vaccination supplement - CS signed part 6!

March 27, 2010: Green Card recieved

ROC:

March 1, 2012: Mailed ROC package

March 7, 2012: Tracking says "notice left"...after a phone call to post office.
