Custody and Leaving the Country

Timeline

Went to court a week ago and the judge granted my application to leave the country with my daughter (my ex is her father). :thumbs:

So very happy to have that loose end tied up. He fought me over it, even though he hasn't seen in her 2.5 years. :no:

Now all I need is that interview date and we're good to go - we've been lazy about processing, but just send the DS-230 and AOS yesterday.

See my other post about THAT fiasco! LOL ;)

Please let us know how it goes at the interview. My question would be I have seen numerous memebrs who have the custody docs however NVC still asks for a recent letter from the other parent allowing the Child to immigrate to the US. Good Luck

Why is it that the only one who can stop the crying is the one who started it in the first place?

I-751 mailed 6/30/09 aapproved 11/7/09 The BOYS I-751 Mailed 12/29/09 3/23/10 Email approval for 17 CR 3/27/10
4/14/10 Email approval for 13 yr Old CR 4/23/10

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )
I-130 approved 2/24
Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

I think the difference here is that this isn't just a sole custody document - Cindy mentioned "the judge granted my application to leave the country with my daughter ".

Ahh cool, PLease though let us know if the NVC accecpts that as it may help other memebers in the future especailly the few that are bringing the kids from Canada. Hopefully they will accecpt this. I think it is Canadian girl ho is also going through the same thing.

I think the difference here is that this isn't just a sole custody document - Cindy mentioned "the judge granted my application to leave the country with my daughter ".

Absolutely!!....I anticipate no problems. It's actually states in the document "the mother shall be permitted to relocate anywhere in Canada or the United States of America with the child". It's a final parenting order, and there shall be no further ex parte orders. It's an original, certified copy so.....no, it won't be a problem. Anyway, fathers wereabouts are unknown, so it's impossible for me to get the letter.

I've travelled with her frequently across the border, and they always ask to see the custody documents, but they never have issue. In fact they always so, "oh good, it's spelled out in item xx, that you can travel internationally". I think it's great that they check, I'm always pleased when they do.....no one should be able to travel across borders without a valid document releasing that child to the other parent.

Oh and it may be a little differnt for me, as she is not being sponsored. She already holds dual US/Canadian citizenship. =)

Good info to know!

I'm absolutely sure it is no different because she is a dual citizen already though.
