5 years custody of Petitioner to son

I just want to inquire if its true that once you got petition by your father or mother - you should have free shelter, water, electric .. except for a car for 5 years? As in for 5 years? even the beneficiary is already working and the age is 40 years old? What if the father decided that his son should pay for rental - is this ok or the son can sue his father(petitioner) for asking for payment for the rent? Please give me some infos about this.

I am not sure if we are on the same page, but if you are the beneficiary of someone who is sponsoring you to the US, they sign an Affidavit of Support with the US government. This does not mean that they agree to provide the beneficiary with free food, free accommodations, free utilities, a car or anything. It means they they agree to assist or support the beneficiary so that the beneficiary does not apply for Welfare or other type of government tax-based support when they have not contributed to that tax base. In the case of a husband and wife or elderly parents, most petitioners agree to support the individuals by providing a home and related expenses and help them to meet their daily living needs. In the case of adult children or siblings who are more than capable of working and being responsible for their own financial needs, the petitioner is not responsible for providing them with a 'free ride'. The beneficiary should expect that he or she needs to get a job and learn how to support themselves.

The affidavit of support is in place until the beneficiary has earned 40 quarters of employment contributions to Social Security (10 years of continuous employment), the beneficiary becomes a US citizen, leaves the US permanently, or either the beneficiary or petitioner dies.

I repeat, the contract is with the government to ensure that the beneficiary does not become a burden on society. The beneficiary can sue the petitioner for not giving them a 'free ride' if they want, but there is no judge who is going to award a 40 year old man free rent, a car or anything like that based upon the Affidavit of Support. It will also cost the same son a lot of money in lawyers fees. He would be much further ahead planning on getting a job ASAp and forgetting about the 'freebies'.

im kind of confused as to the question but i will try my best to answer.

if the person is 40 years old and working he should be able to support himself.

i think that even if he has a sponsor once he or she reaches so many quarters of working then the sponsor is no longer responsible for that person i might have it wrong but i seem to remember reading something about that.

ok ur right about that but im confused about the question he is trying to ask, does he mean that the beneficiary is working and can support himself but still wants everything free? i just think that its confusing the way that the question was asked so kind of hard to tell what he wants to really know :)

yes you are right.. these 2 sons are overage (35 and 40 yrs old) and they are both working....

Technically, the affidavit of support DOES obligate the sponsor to support the beneficiary to maintain their standard of living at 125% of the poverty level. Could they get free rent, food, etc.? Theoretically, yes. But that would only be up to 125% of the poverty level, and would be offset by any income the beneficiary already had. Unless the beneficiary is working part time in a fast food restaurant, they are probably already above this threshold, and would get nothing from the sponsor.

There have been successful lawsuits based on the affidavit of support, but almost all of them involved a beneficiary who was married to the sponsor. In those cases, the affidavit of support was used to establish the spousal support payments in lieu of the guidelines set by the state of residence. In cases where the state guidelines would provide a higher level of support (which is in most cases where the sponsor has decent income) then the affidavit of support is ignored.

Seriously, why would anyone want to be supported at a level which is barely above the poverty line if they are capable of doing better on their own?

Also, the term of obligation for the affidavit expires when one of the following events occurs:

1. The beneficiary has accrued 40 quarters of Social Security work credits.

2. The beneficiary becomes a US citizen.

3. Either the beneficiary or the sponsor dies.

The only way this works out to 5 years is if the beneficiary and sponsor are married to each other, both working, and accumulating combined work credits. It could also work out to slightly more than 5 years if the beneficiary becomes a US citizen as soon as they are eligible (presuming they aren't married to the sponsor).

Why would a grown individual who also works, expect to get a piggy back ride from parents. If the person is working, maybe not much, then say to his/her parents what they are earning and try and make minimal contributions to the household. If I sound harsh, then maybe I did not fully comprehend the question asked.
