Hi All,

I need some advice. I'm getting more and more confused the more I read all these Message Boards :)

My husband filed an I130 on my behalf on June 13th. We had initially thought that filing a K3 visa would get me to the US faster. Reading alot of people's timelines I'm wondering if that's the case.

My case is pretty straightforward in my opinion. I'm Canadian. I'm in Canada right now with no plans to move to the US without a Visa. I have a good job in Canada & my company also has an office in Florida which I will transfer my payroll to once I get my Visa.

We filed though the TSC.

Opinions? Should we still file the K3 application? Once we get the NOA on the I130 of course, which we haven't received as of yet. My understanding is that the TSC is a little behind right now.

I would appreciate anyone's opinion / input on this matter. We don't want to waste time / money unnecessarily.

Oh ya - can anyone explain what IMBRA is? I've been reading about it all over the place but no explaination on what it is and how it's affecting processing times of the K3?

You can consider adding the I-129f (for K-3) as a little insurance policy. If you can afford it, it will not hurt you and it might help. As with insurance, there's no way to know if it was worth it until the end. :)

money isn't an issue. If it's quicker I'll do whatever is necessary.

As far as I understand, the I-130 process can take up to a year to complete. Usually the K-3 is much faster, but the IMBRA law has caused a huge backlog - so K3s are much slower now. Still, it is POSSIBLE that a K-3 might still come through before the I-130. If you don't mind risking the $170 or so, I'd do it anyway, JUST IN CASE. I did both, and it looks like at this point they might both be done at the same time. It's been almost five months now. Oh, the new law basically requires U.S. applicants to reveal criminal histories so that some innocent foreign spouse doesn't end up with an abusive husband/wife or unknowingly marry a U.S. man/woman who has a history of domestic violence or other violent crime.
