NVC is asking for a custody papers

hi, i hope somebody help me on this. I am married to a US Citizen but before my marriage i have a 8 years old son who is still in my country. My US Citizen husband filed for the petition and as of now my son's petition is in NVC, my son is on CR2 category. We just received a letter from NVC asking for the Custody Papers. And we are confused coz on my sons birth certificate, im the only one (mother) who signed it. There's no name of the father or acknowledgement of the father on my sons birth certificate and im married to him now so my son is his step son. What we are going to do? How can we provide a custody papers? Is it necessary that my husband adopt my son but im the only parent my son have. please, help me..

Even though you're legally married to your husband it doesn't automatically follow that your son becomes his legal son too.

there is a case similar to yours and what they did was to get a notarized affidavit from the father stating that he does not contest and allows the wife to bring their son to the US. but since in your case no father was declared in the first place you should come up with a legal document (from the your local court) stating that you have, ever since your son was born, been the lone legal custodian of your son and that the father never acknowledged your son etc. this could require affidavits too from friends and relatives supporting your claim.

contact your local court right away for the process/es and requirements.

I am also in your situation..

I have a 3 year old daughter.. her fathers never been in her life, ever. He doesn't pay maintenance or anything. I am the only one who has raised her. He's not on her birth certificate.. and she has my surname.

This thread has helped me as i was very confused where to get this 'notorised letter' from. Now i will contact the courts here and see if i can get a court statement :)
