Hello all!

Just filling out yet another round of papers and I have a question about the fees. My wife was told by a friend that she should file the I-765 (Work Authorization) along with the I-485 in order to save paperwork and fees. Now that I'm filling out the paperwork I can see it saves having to submit the same papers twice, but it appears there is no exception for my category of (a)(9) K3 Non-Immigrant Spouse. Obviously, we processed under the I-130 for her entry.

It looks like I'm stuck with yet another fee, but it made sense that filing together would relieve some of the fees.

Sorry all, found my answer:

If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, and you paid the I-485 application fee required, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

I'm going to ignore the filing location in the I-765 instructions and file along with the I-485.

Hi there!

My wife entered in the U.S. by a K3 (spouse visa). I'm glad I found your post as we have the same case we are also applying for 1-765 and I-485 and now we found out through our research in the internet that we should also apply for I-130. Have you submitted all the requirements yet? Can we apply I-130 together with the I-765 and I-485? if so, can we send these 3 forms together to one address? is there anyone who could give advice please?
