Evidence of Ties to Home Country . . .

Timeline

Hi All,

My fiance is coming to visit on Thursday night. I am looking for advice as to what evidence he should bring with him to prove he's returning to the UK on the 30th.

He is planning on bringing his return ticket and a letter from his employer confirmning employment and stating that he is due back at work on the 31st.

He is here for two weeks and has been here every three months for two weeks since last year.

He cannot bring a copy of his lease agreement as he just moved out of his flat and will be living with friends from the time he returns until he gets his visa.

What else could he bring with him?

03/22/2006: I-129F approved: - 19 days!! :-)

04/06/2006: Package 3 rec'd

04/25/2006: Package 3 sent

Letter received saying our petion has been recalled!!!!

the employer letter is good but he should have more................how about utility bills? car payment? credit card bills?the fact that he has been here so much on the vwp will definetly bring attention to him. maybe he should have his friends copy the lease or something?

Hmmmm. I thought the fact that he comes so frequently and for the same amount of time is a good thing - it shows that this visit is consistent. No?

He can bring a utility bill from the flat I suppose although I'm not really sure what that proves. I don't think that bringing his friends lease agreement will help either as he won't be listed on there. :-(

Unfortunately, he lives in London and never bothered learning how to drive nevermind owning a car! He does have a loan so perhaps he could bring copies of that statement.

I'm flying to LA this week from Australia on VWP also.

I am bringing copy of the letter from USCIS website regarding the IMBRA delays - figured that would explain to them why I cant wait until I get the K1 visa.

Copy of title to land.

Copy of letter I wrote to my daughter's teacher explaining she is missing 2 weeks of school and could she provide any additional homework.

I like to think that regular visits on VWP and the fact that I have never once changed extended the length of visit will show I have not intention of committing immigration fraud.

The fellow's history of of visits to the USA actually works in his favor, as opposed to those people who 'visit' the USA for 3 months at a time and then return home to 'live' for 2 weeks before their next 3-month 'visit'.

The fellow's history of of visits to the USA actually works in his favor, as opposed to those people who 'visit' the USA for 3 months at a time and then return home to 'live' for 2 weeks before their next 3-month 'visit'.

I realize he isn't living at his own place but I was just trying to help-I mean one paystub/letter from an employer doesn't seem like much at all. I just figured something with a name & an adress would help. Even though he doesn't stay the full 90 days-he is still here often. It only takes one poe officer in a sh*t mood to deny entry-so why not have all the proof you can? :yes:

some people don't have a problem at the poe some do-good luck to ya!

As usual Yodrak has it right. His consistent history of only staying a couple of weeks is in his favor. There is always a chance that some immigration official could question him, but I dont see an issue, especially with the documentation he is bringing

Visa Waiver Program. Can travel only on Passport. very cool option, but they can also deny entry and you can lose your VWP privileges if they think you are trying to immigrate

Just trying to explore the thought process behind the suggestions. How does something with a name and address dispel immigrant intent? Such things as living quarters, a job, a car, are easily done away with. Indeed expatricia's fiance has already done away with his 'permanent' address and is living at a temporary address pending issuance of a visa.

Credit cards (and money in the bank) can travel with one whether they're visiting or immigrating.

'Proof' has got to prove something.... A person's best proof is themself. You are quite correct that POE officer is going to decide based on their experience and intuition at the moment, and it is very subjective.
