Citizen and Filing I 485 for my husband pending I 130

Hello.. If someone could help me that would be really appreciated. I just became a citizen couple days ago. I have filed an I 130 for my husband when i was a green card holder and have received the receipt. My questions are :

1. When I am filing the I 485 what do I put in the Current USCIS Status section as well as the Expires on date section? Should I put Pending I- 130 and put N/A on the expires date section?

2. On Part 2 the applying section which one should i put A or B ?

3. When submitting the application how do i show I am a citizen, should i include a copy of my naturalazation document along with the packet?

I am doing this on my own and would really appreciate all your input.

Answer to your questions:

1. Yes

2. Not sure- I checked H and put 'spouse of a U.S. citizen and filing based upon a pending form I-130,' remember your husband is filling out the I-485 not you. Don't know what's your situation.

3. Yes, include a copy of your naturalisation certificate and copy of your U.S.passport.

Use the guidelines provided on this website, especially the example forms,this was helpful to us as our AOS is pending and we also did it on our own and will be doing biometrics soon.

7/14/06 - sent I-130

7/18/06 - notice of arrival I-130

8/03/09 - received approval I-130

7/28/09 - sent AOS package

7/29/09 - arrived Chicago lockbox

8/05/09 - touched

8/07/09 - received notice of arrival I-485

8/07/09 - received Biometrics appoitment notice for 9/2/09

8/22/09 - did walk-in biometrics (in/out within 30 minutes)

8/25/09 - touched

10/23/09 - received interview appoitment letter for 11/24/09

11/24/09 - Interview - approved received I-551 stamp

11/25/09 - received email from USCIS - card production ordered

11/28/09 - received welcome letter from USCIS (by mail)

11/30/09 - received email from USCIS - card production ordered

12/02/09 - received email from USCIS - I-1485 approval noticed mailed out

12/03/09 - touched

12/05/09 - received 10 year green card in the mail, Thank you Jesus

Your husband's Current USCIS Status like "Overstayer", "Student", "Tourist" etc.....

Expires On Date means his I-94 expiration date, whatever it is, if it was expired, give the exact date as written on his I-94.

2. On Part 2 the applying section which one should i put A or B ?

Just check "a". Plus You have to write a cover letter explaining your situation, I mean changing your status from LPR to USC and the copy of I-130 NOA.

3. When submitting the application how do i show I am a citizen, should i include a copy of my naturalazation document along with the packet?

Yes, You can send a photocopy of Naturalization Certificate and/or US Passport (If any). For your info, if the person has got both of them, When I do their USCIS paper works I usually send both of them.

You said that you filed when you were a greencard holder. The first thing you should do is to inform/update USCIS that you are now a citizen and they will request the documents they need. Good luck.

Your husband's Current USCIS Status like "Overstayer", "Student", "Tourist" etc.....

Thank you all for the input.. My husband came here on as a student but later defaulted his F-1 Visa, should I put Student ?, but he has a pending I-130 so should I put that instead? Or are they more concerned with originally how he came to the states ?
