Question about collecting unemployment

Timeline

Quick summary: Entered the U.S. on a K1 visa in March of this year, hubby and I got married in May, filed for AOS in June, received EAD in July, been applying like crazy since.

Now, hubby has lost his job and is looking into getting unemployment benefit until he can find something else, which has raised the question for us whether or not I am eligible to apply for unemployment benefit as well.

Any insight into this would be highly appreciated.

No, I have not been working. I only received my EAD a couple of weeks ago.

No, I have not been working. I only received my EAD a couple of weeks ago.

Then you can not apply for unemployment (it is a benefit you pay in to while you're working, it is much different than systems in other parts of the world).

No, I have not been working. I only received my EAD a couple of weeks ago.

Unemployment is only available (for a limited time) if you where recently employed.

No, I have not been working. I only received my EAD a couple of weeks ago.

Unemployment benefits are financed by unemployment insurance taxes payed by your employer. You have not yet held a job in the U.S. so you certainly do not qualify for unemployment.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

Then you can not apply for unemployment (it is a benefit you pay in to while you're working, it is much different than systems in other parts of the world).

Your post indicates you have not been working. If you have not worked & paid unemployment tax you can not apply for benefits. You must work X number of hours in a quarter to qualify for the benefits.
