Travel ban

I know there is a lot of bitterness on this site because of this process and honestly I think many of the posters here have directed their bitterness at this person.

It's not a matter of directing bitterness at the poster -- it's the tone of the post. It's more of a "how dare they impose a travel 'ban' on me" as opposed to "this process is difficult and stressful". It's also a case of "it's my right" rather than accepting the process is hard and that it's a privilege to get to the US. The OP has also indicated that his research was inadequate to begin with, and now he's found out that the K-1 is a one-entry-only visa, he's unhappy about it. It's not like there isn't a way around it, and if he files the I-131 along with the rest of his AOS papers, then he doesn't have to pay any additional fees. Had he been prepared initially and done research -- as many of us have done, by coming to this site and asking questions as well as on the internet (which, let's face it, he seems capable of using) -- then he wouldn't have encountered these issues. Additionally, comparing the US to the Soviet Bloc was absolutely unnecessary and offensive to others on this site. Yes, he's venting, but by coming across the way he has done so, it hasn't won him much sympathy.

Magpie.

I am debating a point that does not makes all of a lot sense but for those that decided to pass personal attacks is not cool. All I am saying is the immigrant are not regarded much higher than a convict that just got released from jail and have been told not to leave the country. This is my feeling about this and I believe any person regardless of its nationality should be able to travel were ever he/she pleases without this ridiculous ban that accomplishes noting. After all most K1 are making real sacrifices, leaving everything behind and this ban is not here to help.

At the interview I am going to raise this point and if the interviewer denies my petition on my beliefs and not on its merit, then what do you think it will show about this person or the USCI! I believe most persons at USCI are decent and open to discussion.

I will remind everyone again that personal insults and attacks are a violation of Terms of Service for VJ. Making judgmental comments and unnecessary comparisons to other situations is also not helpful. Please keep your comments courteous and on topic,.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”

Free of our moves is not a privilege (given by somebody because we are nice) but rather a right and at this moment I have to make many concessions around my life just because this moving restriction that was imposed to us..

I wish to know one good reason why a K1 can't travel abroad after the first entry. I take it all back if I can have one good valid reason.

Because once the K1 visa is used, you do not have a visa to re-enter the US if you leave.

Might sound offensive to you but its logical and sound advice. If you are one of those people who wants rosy pictures being painted for you instead of reality then VJ is the wrong place for you.

here we go again! VJ members dont seem to know how to give "logical and sound advice" without personall attacks.

DanielParul was not attacking you personally. You might want to read posts a little closer before commenting on them in the future. Your comment was a totally baseless generalization not to mention insulting to all of the helpful people that roam these forums. Calm down.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

We are finding out while adjusting we are not allowed to travel abroad!!! It is insane to both of us to be subjected to this kind of treatment. No one in our life stopped us from traveling freely and here we go, the US, the alleged most free country in the world can tell us when we can travel and when we can't. We are not anymore in the 80's East block anymore. What is the purpose of this?? We are not criminals. What do they think they are???

Further the all process of obtaining a visa for a spouse is ridiculous, heavy, un-respectful, expensive and borderline comical and stupid. I have better words for it but I should be nice! I tell you it does not show well to the rest of world, the way foreigners seeking visas are treated with this process. I am certain we will get many objections from the US if a US citizen has to be going through this type of process from another country.

Actually, government enteties have been telling you where you can and cannot travel all your life, that is what a visa process is. Every time you go to a foriegn country, you require permission from their government to let you in. Maybe you have not felt any practical effects of the rule before now, because you have been able to obtain a visa at the airport in your travels, but that is not an advantage shared by everyone. My aunt, for example (Pakistani citizen), was denied an entry visa to the EU last year, how's that for not being able to travel freely?

Wow didn't know there were so many people supporting the USCIS on here. Everyone must appreciate their waits no? Maybe USCIS should raise fees further and reduce staff to increase the time you wait further...you know to increase your support for the organization.

YES I ABSOLUTELY AGREE WITH YOU.

My point is that he is simply venting about the situation he's in. If you actually look back at his first post you'll find he also spoke of his K1 not just the AP.

I'm just a little surprised at all of the "if you don't like it then leave comments" from a group of people who are supposed to be supportive given this is an immigration website. There are probably two to three venting threads on this forum a week and normally the poster gets positive reassuring comments. I'm somewhat dismayed at the negativity he's received and can only assume its because they are both here in the US already and are considered in the "extremely lucky category" (even though we all get there in the end). Had he posted this within a few months of filing and they were still separated my guess is the comments would have been kinder.

I know there is a lot of bitterness on this site because of this process and honestly I think many of the posters here have directed their bitterness at this person.

Right on mate! I'm with you on this. Not just the negativity that is surprising... it's also the replies that state the obvious.

OP, nobody said that you could not leave the country. Feel free do so. The US goverment (through the DHS and State Department) gave you permission to enter the country once to get married. Now, you can go to any other country that allows you to enter with your Swiss passport (and perhaps a visa). But, to come again to the US, you will need the permission of the US government since you are not a US national. You can apply for a visa for such permission (CR1, K3, a tourist visa if you just want to visit, you might be able to get in using Visa Waiver with a Swiss passport, but might also be denied since you are married to a USC unless you show strong ties to Switzerland and an intent to return ).

You cannot enter any country you want at will with a Swiss passport you know. Nobody ever told you that? Well, then I guess your travels have not been too extensive. Plenty of world travelers have passports littered with visas for permission to enter a country (NOT TO LEAVE). There are plenty of countries that require you to get permission (aka a visa) to enter with your Swiss passport. You got a visa (a single entry visa) to enter the US. The US does not care if you leave now, they are not holding you prisoner. If you get AP, you can re-enter the US. If not, you must get another visa.

Sorry but I can't sit back and shut my mouth right now....

To the OP :

1. YOU ARE finally with the person you love-why not be happy about that long process being over and done with instead of bitching about "being stopped from traveling"

2. I suppose you knew the rules when you applied for a K1 Visa to be with your loved one,if you didnt know the rules you obviously didnt take the time to GET the information

3.Would you have gotten married in Switzerland (or even in the US ) you could have applied for a multiple entry K3 Visa, which would enable you to re enter the US

4.nobody on this site likes how long the process is and 6that family Immigration is very comlicated and nerve wrecking at times, but ALL of us knew beforehand what we are getting into,so making it sound like the US hold you hostage here is ridiculous !

And last but not least 4,if you like (liberal) Switzerland and how they run their Country and what Immigration Laws they have oh so much then PLEASE feel free to get on a plane and leave ! But do me a personal favor and dont get AP before you do!
