I dont get it! I'm sitting here dying to be with my fiancee in the US and your dying to get out. If the US is such a crazy place then why did you you move there? Did you not take the time to educate yourself about the visa process and it's limitations? You have to chill out and realize how lucky you are to be there with the person you love. I have to talk on the phone everyday to my fiancee as we make plans to move and plan our wedding - that's tough and sad, but I take it like a man. Just SHUT UP and grow some balls and realize that you have what many people on this site don't and that's the opportunity to be with your wife.

By the way, you should get nice and pissed off in your interview. I am sure the officer would be interested to hear your thoughts. Hell, I am sure he'd help book your flight to Zurich too.

Our taxes pay for their salary and they should be reminded of this now and again.

And be sure to use the words "I pay your salary."

Actually - this should not be encouraged - a civil servant has no more ability to change the law/rules than you do.

I am debating a point that does not makes all of a lot sense but for those that decided to pass personal attacks is not cool. All I am saying is the immigrant are not regarded much higher than a convict that just got released from jail and have been told not to leave the country. This is my feeling about this and I believe any person regardless of its nationality should be able to travel were ever he/she pleases without this ridiculous ban that accomplishes noting. After all most K1 are making real sacrifices, leaving everything behind and this ban is not here to help.

At the interview I am going to raise this point and if the interviewer denies my petition on my beliefs and not on its merit, then what do you think it will show about this person or the USCI! I believe most persons at USCI are decent and open to discussion.

I for one applaud you and hope you do so fervently. Good to see someone standing up to the public servants that work for us taxpayers. Our taxes pay for their salary and they should be reminded of this now and again. Again good luck and God bless. :thumbs:

USCIS is paid by the fee's we pay, i don't think they use tax payer money...

I see where he's coming from though. K1 approved, got married within 90 days and AOS in progress; there is no reason why you can't go about your life or pursue your passions. As far as I'm concerned, requirements have been met so why be stagnant while waiting for the next process to complete? AOS is not a quick process either. We are talking about another 3-6 months guys. Not to mention that's a $300+ fee. In essence you are paying quite a bit for freedom. You wanna travel, you pay and you wait. You wanna work, you still pay and you still wait. Does that really makes sense everyone? I think not but it is what it is like you all implied but the OP is not wrong for expressing his opinion.

The EAD issue is much bigger IMO. I've never seen the reason for the gap.

Now, to the OP, if you are the petitioner, run for office, and change the law. Unfortunately, venting on an immigration forum will not change the LAW. Go door to door and collect signatures. Complain at the interview, do whatever you want. You knew what you were letting yourself in for. Maybe you believed that the K1 was faster in getting your fiancee here. But, as you have now found out, there is still more waiting to come. As a matter of fact, why don't you run for office. There are plenty of immigration laws we on VJ would like to see changed :thumbs:

Kathryn, I believe that telling someone to go back to where he is coming from is far more offending than what my post contained. Apologies for any harsh words.

So, the meaning was "You made a mistake, you need to deal with it and wait for your AP - I am appalled" - Does that make a difference?

The Switzerland and Monaco are among the most desirable places to live and to migrate to, at least for those who have deep koffers. Next in line is -- surprise -- the United States of America, one of the riches and larges countries on planet Earth.

While the immigration process can truly be frustrating and deserves to be improved upon, I don't see that happening any time soon. Not by protesting of individual applicants, and not by a revolte of civil disobedience by many. It's like changing the prison system from within, which is a lost proposition if the majority of the inmates are up for their long anticipated parole hearing and thus won't participate.

A change from the outside is unlikely as well, considering that those officials involved in the procedure are not interested in working actively on change, whereas the general public is a herd of ignorant sheep who don't know squat about the aggravating immigration process.

But view the process from the devil's advocate's prospective, if you will. Someone decided to immigrate to the U.S. They are commmited to make it their new home and many have waited literally years for the opportunity until they became part of a small group called the chosen ones.

After entering the U.S., immigrants are free to travel. After all, their new homeland is huge and there's much to see, more than could be accomplished in a few months. Now somebody dropped off their paperwork, and then wants immediately back to where they came from. Sure, if that's where your heart is, you are free to even leave the country and travel thousands of miles over an ocean to a foreign continent.

One favor though: don't come back until you are certain you want to live in the U.S., and not in Switzerland. We'll be waiting for you until then, and at that time you are free to submit a new application.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . I agree it is quite a long process to go through.

Honestly, quite a few of us have been able to complete this process within three months [including me, I just got approved this Tuesday].

If you do want to travel, however choose not to apply for AP because of the extra application fee you may travel within the U.S.

tbh, the U.S. is not a bad place to travel, there are still yet many places I'd like to visit.

Learn to adjust to the situation and be positive about what you already have, not what you want to have.

Live in the present, not the past or future.

p.s. just fyi when we had the AOS interview this past Tuesday the IO did not want to talk about anything apart from the interview. When my hub wanted to strike up a convo. w/ her, she glared at him and just went on with the interview. so don't assume everyone is decent and open about what you think. The IOs probably go through many interviewees each day, they don't have time to be wasted.

We are finding out while adjusting we are not allowed to travel abroad!!! It is insane to both of us to be subjected to this kind of treatment. No one in our life stopped us from traveling freely and here we go, the US, the alleged most free country in the world can tell us when we can travel and when we can't. We are not anymore in the 80's East block anymore. What is the purpose of this?? We are not criminals. What do they think they are???

Further the all process of obtaining a visa for a spouse is ridiculous, heavy, un-respectful, expensive and borderline comical and stupid. I have better words for it but I should be nice! I tell you it does not show well to the rest of world, the way foreigners seeking visas are treated with this process. I am certain we will get many objections from the US if a US citizen has to be going through this type of process from another country.

As always, anyone is free to travel and leave the USA. A person going through the fiancee visa process cannot leave and return without an AP. Leaving and traveling are not a problem. Returning IS. But you already knew that when you "signed up" for the process or you could have gone the CR-1 route and avoided that part. The USA offers several options, you have the restrictions of the one you chose. In all my travels around the world I have found ONLY the USA and Canada that allow people to LEAVE without inspection of any sort. Your comparison to the Soviet bloc is particularly insulting to people who lived there...like my wife. If you want to LEAVE...please do so. Bon voyage!

I presume that Switzerland also has procedures for people wanting to be lawful permanent residents. I suggest you follow through with the process you agreed to.

Yes we understand it's a Hotel California deal. I can't speak for OP but I sense that a mere simple AOS-in-progress should be enough to allow re-entry. The fact that we go down the K-1 route implies the intent to start life in the U.S. Sudden death in the family is one reason you may have to be out. Is AP even a candidate for accelarated processing? By the time you finish the AP and biometrics form, the funeral will be over.

And dang I'm still waiting for my NO2. Ulkkkk... ok sorry this is out of topic.
