Hi All,

So I split up with my ex wife during the 2 year conditional period and returned back to the uk to live. Before I left I checked in with the INS to see if there was any formal procedure I had to do before I left. I was told to just leave and let my conditional green card expire. So I left.

Just after the time I was due to remove the conditions my ex received a letter stating that we had failed to remove the conditions and my status was terminated and I may face removal proceedings. I though this odd as I had left about 6 months before and as nothing further was received I did nothing about it.

I did eventually find out that its a good idea to officially relinquish my green card and abandon my status (this was about 3 years later!) so I filled out the I-407 and sent in my green card to the US Embassy.

I have now since read that after receieving the letter stated above, I should have also received a Notice to Appear (in an immigration court!) Had I received such a letter I would have acted on it immediately, but she never received this. Ive read that if you dont show up for your hearing that they may just go ahead with the proceeding and then you end up being 'Deported Absentia' so I would on paper, technically be deported.

I am really worried that this might have gone on without my knowing and I have a deportation on my record without knowing a thing about it! As far as I was aware, I left the country legally, didnt overstay and all was good.

Oh, and this was nearly 8 years ago that I left the US and have not tried to go back since, but I dont want to have such a thing on my record particularly when I have tried to be a law abiding citizen.

Has anyone else left within the 2 years? How did you go about it? Can anyone offer any advise on the above that perhaps knows how I can clear my name? Does the fact that she didnt receive a notice to appear mean that it never went to court? how can I even find out!?

Hi James. I'm going to move your thread from ROC to the Effects on Major Changes forum so your situation can be addressed appropriately. I do believe there are a few threads in there that are similar. Maybe do a search in that thread specifically. Good luck.
