Anyone know a really good Immigration Attorney??

Hello Yvette I certainly understand your distress. I consulted a bit by telephone both Mr. Huang & Mr. Ellis. They are equally are knowledgable and both good at what they do IMO. I did not use either personally, it was too expensive and I was not sure they would ultimately be very effective at changing the mind of the moroccan consulate (which was my goal). I tried using the congess and senators offices also, and I faxed a letter to every senator, congress person, etc.....just in case telling them basically that I own a business, pay taxes, etcc..... and I deserved help from them...yadda yadda... Hey I was desperate! What were they gonna do black list my name? LOL. I sent the letters from friends and family (even husbands father) addressed to the consulate chief himself because I called the consulate and emailed the consulate everyday until I got the consulate chief himself and ..he actually listened to everything I said (calmly and respectfully of course) The consulate chief told me to send him everything I thought that might help addressed directly to him and he would call me if he had questions. My husband got a call that the consular chief wanted to talk to him personally. (this was after that disasterous interview with the infamous blonde lady..who accused my husband of being gay and using me for the visa etc...) my huisband got his visa 1 week after the interview with the chief. My husband also became very immotional when he got outside the consulate (I think it is the preasure release once you are outside) It is very stressful! I think our husbands and fiances do not suspect that the interviewer will sometimes really accuse them and interogate them so badly. The consulate feels you are GUILTY until proven innocent. If they can find or create anything out of anything you do or don't give them, they will. So with that in mind (you have your work cut out girl!) Try to think like the consulate and convince them that ....it was just fate that your daughter accompanied you to morocco and fell in love with the brother of your new husband. It is not Halal BTW...they were pulling his chain (you know that)....halal if it was an actual blood daughter of his brother perhaps. Olive

I'm guessing you meant to say it was not haraam? :)

HHHHHHHHHHHHH! Yes thanks for correcting that Amysaid. I read "halal in the original message post and completely overlooked that it was the wrong term.

She did WHAT? Heavens to Betsy how could one human being be so cruel!?!?

You know, it's probably one thing for a man to be accused of immigration fraud, but to accuse him of being gay on top of it?

I'm drop-jawed.

There is a thread at the top that is pinned specifically for returned petitions. The consulate can refuse to give the visa, but they do not have authority to revoke the original petition. I think that is a good place to start. You have already sent the consulate letters of support, correct? Good start. You have already contacted your local representative. Are they assisting you? If not try another one until they do.

You didn't say if they received a paper after the interview called the 221g. Did they? Do you know where the file is now? We need more details to assist you because if the file is still at the consulate there is a small chance you can get them to turn this around. If it has already been sent back to the USCIS it doesn't mean that he will not get the visa, it means that they will have to prove their case to the USCIS, and if they win they will send it back to the consulate with the recommendation that they issue the visa.

This is a difficult process, and I remember when he was denied the K-1 visa. I am sorry for what she is going through. Do you know if they expired the I-129f? Is it possible that this is still active? Could this be why they denied the CR1? Whatever the case it isn't the end of the world, and there is still a chance to get the visa. It is a lengthy process however. We had a returned petition, and we won, as have many others. I had consulted with Marc Ellis, and I recommend him highly. He is very experienced with returned petitions. I didn't hire him personally because he said our case was very strong, and the most he could do for us was to organize our papers (honest too), so we did it alone. From what I have read I think they are just blowing smoke. They have no proof that your daughter was paid (they thought I was paid as well). But yeah, it isn't a bad idea to consult with a good lawyer just in case. But please be careful. Some lawyers have no experience with returned petitions and will lie about it and screw you over. Marc Ellis is the only one I would trust personally.

I just talked with his assistant and I asked what percentage of visa applications are rejected out of Guangzhou. The assistant responded that 80.0% were rejected. I've heard of all the problems from the Guangzhou Consulate. I have also read on "candleforlove" and a couple other sites that if an attorney claims an 80.0% rejection rate from Guangzhou that you should avoid that attorney because their quote is inflated over the actual rate. I also asked the assistant how successful the firm was at processing K1 and K3 visas. The response I received was that if there is a rejection it's not the law firm's fault because the rejection is based on the petitioner and beneficiary's situation. Although I don't disagree with the statement given, the response did not answer my question and deflected responsibility at the same time. I would suggest that any visa rejection would include extenuating circumstances such as the attorney failed to provide enough due diligence to determine the client's situation was such that the application would fail. I still have interest in hiring this firm but I'm continuing my due diligence before paying for the initial consultation.

Can you provide more information about your experience with Daniel Huang and possibly some background information on how complex your application was?

I did not use him for visa processing. I had a consultation with him via phone where he spent quite a lot of time explaining and making sure I understood exactly what was going on in our case. I had two pages of questions, and he was extremely patient, knowledgeable and thorough. I recommend him only because with me, despite not being hired, nor having a stake in my case, he really took the time to help me. I can only go on my experience - if I ran into a roadblock, yes, absolutely I would hire him.
