I am so new to this site and found out it is extremely helpful.

Here are my questions:

1. if my salary is enough to be both my parents' sponsor, do I need to fill I 864A for my husband since we fill tax together as joint? If so, do I need to fill I 864A for each of my parent or only need to fill one for both?

2. for question 25, do I use my own salary from my W 2 or combine house hold income from tax return for I 864 for the last 3 years?

3. I am applying DS 230 for both of my parents and just got the NVC case number assigned on 8/14/2009, after they arrive in America, do I need to fill I 485 to apply green card?

If you can cover it with your income, your husband does not need the 864. You would use the 864, not the A. If they are on separate applications, separate 864's are needed.

You would use your own income (since your husband is not sponsoring)

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Hi and welcome.

1. You only need the I-864, as you have enough income on your own your husband does not need to complete I-864A

2. Yes use the total on your own W2.

3. Once your parents get approved at their interview they will have a immigrant visa IR-5, once they enter the US on their visa they will get a greencard mailed to them within 90 days of their arrival. So they do not have to file I-485.

Thank you for the fast responses.

One more question: do I need to send all required certified copies with DS 230 AND another set of regular copies or just the certified copies are good enough?

How will I ever get all certified copy back?

Here is what I was told to do by NVC when you are applying for both parents.

You will need a photocopy of each original document you are going to send. In my mothers DS-230 I had all the originals. In my Fathers Ds-230 I had all the photocopies of the originals. On each Photocopy I attached a small sticky tab and wrote on it "ORIGINAL HELD IN NVC CASE #LND2009***** "

My mother told me that when they went for the interview she could see all the little tabs still on my fathers papers.

Your parents will be given all the original documents back when they are at their interview.

What is the difference between tax return and IRS transcripts? Do I need both for I 864? Do I need to send all supporting shedules for the tax return? Thank you very much in advance for your expertize opinions.

If you send a copy of your tax return you will need to include all your W2's and supporting schedules. If you send a tax transcript then that is all you need to send.

You do not need to send both. NVC prefers a tax transcript as it has been issued by IRS.

Now, what is your suggestion to send in the package:

Can i have one cover sheet for both parents and one set required documents or separate them and fill individually? Thank you soooooo much.

You need to have two separate applications, each with the required documents. You can mail them both in the same envelope but each parent needs their own application.

I will have two applications, how about tax transcipts, employement letter, and cover letter? One set for both applications since the required document will be the same or two separated sets of copies for each application? Thank you Tayrivers!!!!

Here is how you do it..

In one application you will put all the original documents. In the other application you will put a photocopy of all the original documents with a sticky note on each document saying "ORIGINAL HELD IN CASE # (put case number from the other application here)"

That is what I was told to do by NVC and Mom said the little sticky notes were still attached to all the paperwork when the went to the embassy for their interview.

The amount you need to be able to sponsor your wife depends on how many household members you have. If there is only you and your wife then you would need to earn over $18,212.00
