Divorce Decree of Petitioner needed for NVC

Hi, I am about to put together all the Documents for the NVC Package.

For "Petitioner Documents" it is written:

"Applicants in the following visa categories are required to provide 1) an original or certified copy of their Petitioner’s birth certificate and 2) original or certified copy of their Petitioner’s marriage certificate from the Petitioner’s current and all previous marriages.

Parent of a U.S. Citizen who is at least 21 years old (IR-5)

Brothers and sisters of United States citizens (F4) "

But it doesnt mention if you have to submit as well the divorce decree of any previous marriage of the Petitioner. Anybody knows?

Hey there.

I had the same issue, i decided to send my husband's divorce decree (he's the USC) even though they'd seen it at USCIS, I figured it wouldn't hurt for them to have it at NVC even thought they mainly want the beneficiary's info.

I figured why the hell not? It did not cause us any harm at all so i say, if you have it, may as well send it.

I missed this part (Petitioner marriage cert. form the Petitoner current AND ALL PREVIOUS MARRIAGE???? ) Is this right? I dont see this in the NVC shortcuts

I dont have them, only the divorce decrees.

So, when I get to this stage, my divorce decree is not going to be enough. I need a certified copy of my previous marriage certificate? Is this true? I got married in Colombia, so this is going to be fun...

I see only this:

  • Completed DS-230 part I & II and ONLY part I signed by beneficiary.
  • Photocopy of the beneficiary's passport biographic data page.
  • Original/certified copy of beneficiary’s birth certificate.
  • Original/certified copy of beneficiary’s and petitioner’s marriage certificate.
  • Original police certificates of the beneficiary.
  • Original/certified copy of military record, if applicable.
  • Original/certified copy of divorce decree, death certificate, etc. of previous marriage, if applicable.

yeah, you don't need to send the Petitioner's divorce cert... I did as I had it and figured, why not? It won't hurt to send it at all, if it's your last certified copy, maybe not but we have a few so, I sent it...

I followed the list of items relayed to me by the NVC, and at the last minute added my husband's divorce decree just because I couldn't decide if I should send it or not. We had to for USCIS, but NVC did not ask it of us. It did not effect our case one bit and well, it put my mind at ease.

Sorry, did not mean to make this convoluted at all...

I would say yes - just to be on the safe side, one more paper does not hurt :thumbs:

I sent extra documents without NVC requirement and we knew that was the right way because we'd get RFE anyway for something they didn't ask originally :thumbs:

Im so confused now! Do I need to send them my (me U.S. citizen) my past marriage cert? I DO have my divorce decrees only.

I don't think this is a regular beneficiary/petitioner form. First. Is it the AOS or is it the IV forms?

If it is AOS, none of the items mentioned are needed.

If it is the IV package, all things relevant to the beneficiary only are needed. All things. Nothing at all from the Petitioner. This is normal mandate.

What the OP has queried is either an irregular case OR a co-sponsors case or some such thing.

Please. Just read the forms that you've received in regard to YOUR case and follow those guides. Its' way too easy to get baffled.

What we need is more info from Anja. This does NOT sound like any NVC package we filled out. Anja, if you're around, what package are you at? What are the from numbers?

Then people will be able to help you. Now we've just succeeded in confusing ourselves! :)
