OK..

Hello All!

We are married and obviousl filing the K-3 but do I need to be there for the interview with muy husband? I ask because I want to see him soon and we can not afford for me to fly back again for the interview. My lawyer says I do not have to be there..but just want some feedback here...Will it look better to the Embassy that I am there for the interview? If so I woul drather just wait and go then, any coments thoughts or suggestions..

Just as of right now it would be me going there in September vs November?

Also whay is an RFE? Will you always get one ?

Some consulates like you to be there, some will allow you to be, some wont allow you to be there. Sometimes it can be of benefit, sometimes not. Sometimes it can be detrimental as has been shown by some posts in the past. It all depends on the individual consulate.

An RFE is a request for further evidence. Not everyone gets one as it is only sent out if the petition is not completed fully, documentation is missing, further documentation/evidence required etc. Also if the old I-129F was submitted which was not compliant with the IMBRA, an RFE will be sent in order to answer the additional questions relating to the IMBRA.

I know i have a bit of time before the interview, but I need to arrange for my tickets if I am going to go sooner rather than later..

Not that I can pin point off hand right now. In the archived threads which are accessible by using the advanced search link in the top left of the page there are posts of how having the spouse attend the interview has created issues by way of questions asked by the conof to both parties, that has lead to visas being denied because answers did not match up. It is NOT something that seems to happen a lot but it has happened according to the posts. At many other times however the spouse being in attendance is very helpful. Like I said it is totally consulate specific as to whether you are even allowed to attend.
