Sara, Perviz is a cardiologist from what you told me. Can he try to take the USMLE (American medical boards) in India and then try to get sponsored to work here? I'm not sure how much cardiologists are in demand, but that's definitely a high-skilled career and there quite a few foreign docs at my hospital.

Then he could come here and you could get married and try for the marriage visa and it wouldn't matter how long it would take since he'd have work authorization to stay.

I will do some research on this tonight--that is if my patients don't crash

I know you are a muslim, but when in Rome do what the Romans do...go to a church...ask them to help you. You need to be HEARD not read!!!

I also noticed you said you will be off your parents medical insurance....how about getting a part time job? that will help with your insurance, some pocket money as well as you might come across someone who can pull some strings somewhere!!!

If oregon doesn't do it for you.. How about you and your mom go somewhere else! Drive down to a neighboring state...get a job...get senators from that state involved! Tell them how your life has deteriorated with all that has happened to you. Maybe if Oregon would not recognize a nikah over the phone, try a different state. I know Illinois does.

that is great advise but i already own my own small small business that im building it took a hit in the economy, then thousands of dollars of bills on medical and student loans im paying off wow what was i ever thinking lol, oregon from what i have seen is one of the hardest states for anything unless u have children.

Oregon does not recognize nikah over the phone but Montana does. we have talked about so many different ways, i have been trying to get an answer as to if immigration will accept nikah over the phone but so for have not gotten a straight answer.

we are spending the rest of this week knocking on our state capital building, its not to far from us, also different organizations that may help.

we will also be hitting the radio stations in our area.

We have contacted the cable company to try to get permission for one of those tickers that run across the bottom of the screen u have seen those right? also we have to get permission from them on how to word it so that its acceptable

i went to osu today as well and put up a flier for help from any student or professor that knows anything about immigration law and how to deal with this

i have been a busy person today, i dont know if any of it will do any good but ur right i need to be heard not something i write, but i will also keep up my writing campaign

Well as long as you can get something on paper I dont see why not.

Like all we had is our nikah in Pakistan....maybe the islamic center in montana and mosque in perviz's city can work together, maybe sign the nikahnama there and send it to you guys so sign here....then you can just file the i-130.

A really old family friend of mine married a USC over the phone as she was not able to travel to the US without the visa and her parents obviously would not allow her to go till the ruksathi...

I am not sure the exact process but I remember they did the nikah over the phone and once her visa was issued she left for US. This was in Kuwait. and her hubby was living in NY.

So its gotta work!

Sorry for adding on posts, but things keep popping in my mind....

The requirement is for you to be married...whether a temple, mosque, courtroom, phone....it beats them.

However, you can't 'tell' them you are married you have to submit a black and white document....so have these molana's do SOMETHING for you!

Yeah, it seems right that you have to take it in the U.S. I remember reading that Perviz was denied a tourist visa to the US, right? Do you think it was because of the K1 application?

I'm sure you guys have already done a bunch of research, but here's a good sticky on doctor forum that I used to go on about foreign graduates taking USMLE and tips on it:

If he can, I think he should try to take steps 1&2 in India now while you're trying other ways to get him here through campaigns or whatever, since he has to take them anyway in order to get licensed as a doctor here.

Then you can really push to get a visa for him to come here to take the test. Maybe the US consulate would be more inviting at this point if he shows that he has already passed steps 1&2. Or maybe a children's hospital would be willing to get the paperwork done for him to be able to work here and then letting him work once he passes step 3, since steps 1&2 are more about medical school knowledge and step 3 would be his cardio specialty.

Oh, and the purposes of you two lovely people seeing each other, like someone else asked before, can you travel to Canada with your health and would he be able to get a visa to go there? It makes me a little heart sick (no pun intended!) knowing that you guys haven't seen each other in so long!

we will look into Canada its only about eight hours from me, i can travel by car. will all depend on what they say about giving him a visa.

he went for the visitor visa they refused to look at any of his documents showing he had to return because he has k1 in the process they told him that plane as can be.

we had thought that the fact that he had not taken any of the test better for the visitor visa but it made no difference. we thought it might help them understand there was no intent to stay.

since i have to be in Portland next week i should go to the children's hospital there and see if there is anything they can do or if they are interested i have his papers or copies of them.

There aren't any words to explain how devastated we are for both of you...we too have our qualms about USCIS and this whole immigration system...and sometimes I wonder to myself if I really want to honor my citizenship to the USA because they have made it the hardest for both of us to be together...we are still waiting in the process, and when I read that you and Perviz are still waiting...we honestly feel your pain (F)

There were times when I called DOS to get updates and I was laughed at by DOS reps when asking about updates to our AP/AR status and called stupid for suggesting that congressmen/senators have access to that information...not to mention the demeaning manner of speaking most of those heartless DOS reps have. Moments like this make me wonder what the he** I am doing being a USC when the country I owe allegiance to is up in arms against the most important thing in my life. So I know what you are going through Sara, when USCIS gives you that ####### about your application being in a "special unit"...special unit my foot!

I understand that Perviz was denied a tourist visa and I see that others have given you ideas to close this K-1 process and to file for a K-3 or CR-1. And I also know about your health concerns making it hard for you to go visit India at this time

So since you say that Canada is only an 8 hour drive from you, and that a third country is an option you can look into, I would strongly suggest closing your current K-1 process, have Perviz apply for a tourist visa to Canada (much easier to get than the USA and they wont give him b.s. about already being a K-1 applicant, blah blah...) and drive to meet him in Canada and then work it out from there so that you can move to Canada with him and start your long-awaited happily ever after together.

Last but not least,

We pray that Allah grant you the fruit of your patience and diligence very soon and May Allah bless you with sound health and may He join you and Perviz together forever very, very, very soon, Ameen!
